Senate Prepares for Star Chamber Trial of Donald Trump

Why it's unconstitutional.

The U.S. Senate is preparing to put Donald Trump on trial after he has already left office at the end of his term and has become a private citizen once again. If the Senate proceeds with this star chamber proceeding, it will be acting in a blatantly unconstitutional manner.

Trump was impeached while still serving as president, on the grounds of alleged “incitement of insurrection.” The charge flowed from the mob attack on the Capitol building on January 6th, which followed Trump’s speech at a peaceful “Save America” rally at the Ellipse near the White House. However, House Speaker Nancy Pelosi did not immediately send the article of impeachment to the Senate, which is necessary to trigger the Senate to proceed with the trial. In any event, the Senate has been on recess and is not returning until January 19th. The Senate is not planning to take up Trump’s trial until he is already out of office and the Democrats assume control of the Senate.

To begin with, there is no merit to the insurrection incitement charge against Trump. In his January 6th speech, the centerpiece of the House’s impeachment article, Trump said to the rally attendees: "We have come to demand that Congress do the right thing and only count the electors who have been lawfully slated, lawfully slated. I know that everyone here will soon be marching over to the Capitol building to peacefully and patriotically make your voices heard." (Emphasis added)

Trump was asking his listeners to exercise their First Amendment right to peacefully assemble, protest and petition their government. There was nothing in what Trump said in his speech about storming the Capitol, committing violence, looting, vandalism or the like. The House impeachment article takes words Trump used like “fight” completely out of context. They did so in a desperate attempt to link Trump to what appears to have been an attack on the Capitol that was pre-planned well before Trump spoke. The rioters acted on their own and should be prosecuted to the fullest extent of the law.

Incitement, assistance, or participation in a rebellion or insurrection against the authority of the United States and its laws is a federal crime. A violation of the law can result in fines, imprisonment and disqualification from “holding any office under the United States.” Once Donald Trump leaves office, if any federal prosecutors are foolish enough to believe that Donald Trump committed such a crime, they are free to try bringing criminal charges against him in a court of law.

A trial of a private citizen, including Donald Trump after he leaves office, for allegedly committing the crime of inciting an insurrection, whenever it allegedly occurred, belongs exclusively in the courts. It is only in the courts where the accused is afforded all constitutionally required due process protections.

The Senate is a political body, with limited jurisdiction to try cases of alleged “treason, bribery, or other high crimes and misdemeanors” against the president, vice president and all civil officers of the United States while they are still in office. The Senate is limited to imposing the political punishment of removing the convicted official from office and only then declaring that such official is ineligible for federal office ever again.

Article I, Section 3 of the Constitution vests the power in the Senate alone to “try all Impeachments.” It goes on to say that “[W]hen the President of the United States is tried, the Chief Justice shall preside.” Article II, Section 4 of the Constitution states: “The President, Vice President and all civil officers of the United States, shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors.”

The Constitution’s text does not confer any power on Congress to indict, convict and punish a former president after he has left office. It speaks in the present tense of when “the President of the United States is tried.” The punishment upon conviction is that “[T]he President…shall be removed from office.” (Emphasis added).

Alexander Hamilton, who certainly knew a thing or two about what the Founding Fathers had in mind, said in Federalist #65 that the Senate was limited in its removal and disqualification powers to the  “dismission from a present, and disqualification for a future, office.” (Emphasis added)

The Constitution’s text could not be clearer. The text alone should end the discussion as to whether Trump can be tried and convicted by the Senate during his successor’s presidency and after Trump has once again become a private citizen. However, those seeking a Senate conviction claim it is still necessary to ensure that Trump can never occupy any federal office again. They cite another clause in the Constitution and historical precedent to support their argument. They fail on both counts.

The proponents for a Senate trial of private citizen Donald Trump point to a sentence in Article I, Section III of the Constitution, stating that “[J]udgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States.” Stephen Vladeck, for example, argues in a New York Times op-ed article that this clause is “the key,  because it drives home that the Senate has two decisions to make in impeachment cases: First, it must decide whether an officer should be removed. Then it must decide whether this person should be disqualified from holding any future federal office.”  Vladeck then argues that since Senate disqualification follows the president’s removal, it must mean that “disqualification, at least, is itself necessarily a vote about a former (as opposed to current) officer.” Trump can, the argument goes, be disqualified from holding federal public office by the Senate after he has left office at the end of his term, as if he had already been “removed” from office.

This is a ridiculous theory to say the least. Leaving office after one’s term has ended in the normal course is not the same as being involuntarily “removed” from office before the end of the term as a result of a Senate conviction. And such removal following conviction by the Senate must precede a vote on future disqualification. If the Senate does not convict, remove and disqualify President Trump before he becomes private citizen Donald Trump, there is no constitutional authority for the Senate to do so retroactively following the end of his term. If there were such authority, a partisan House and Senate could seek revenge on any political enemy long gone from office and prevent that person from ever again becoming a federal officeholder or continuing to receive federal benefits.

The extraordinary power of Congress to impeach and remove a president was not intended as an instrument of revenge. Rather, it was intended as a check against a president still in office and in a position to wreak more havoc on the body politic unless removed. If Trump-haters want to ensure that Trump cannot be re-elected as president in 2024, their sole recourse to seek a conviction for alleged incitement of insurrection is through the courts.

Hold on, say the Senate trial proponents who believe that history is on their side. They point to the case of a secretary of war, William Belknap, who had resigned his position in 1876, just minutes prior to a vote by the House on his impeachment. The House proceeded anyway to impeach Belknap, followed by a trial in the Senate.

Belknap did go on trial before the Senate, but he was acquitted. Why? As Vladeck himself acknowledged, some senators voted to acquit Belknap “because he was no longer in office.” Vladeck argued nevertheless that the Senate as a body had passed a resolution declaring it was authorized to put Belknap on trial for acts that he allegedly committed while serving as secretary of war even though he had resigned prior to being impeached. Since Belknap was acquitted, however, this self-serving assertion by the Senate is a moot point. It remains only an assertion untested in the courts and, as such, has no precedential value.

Not only the Constitution’s text, but plain old common sense leads to just one logical conclusion. The Senate’s constitutional authority to act as judge and jury must be applied narrowly to only current federal officeholders. After a government official, from the president on down, leaves public office, he or she is a private citizen like the rest of us. This person is protected under the 5th Amendment from being “deprived of life, liberty, or property, without due process of law.” Being excluded from holding a future public office is a deprivation of liberty. Only an independent judiciary can guarantee such due process.

As a political body, the Senate is not designed to guarantee due process and impartiality. The impeachment trial process, Alexander Hamilton wrote, “can never be tied down by such strict rules, either in the delineation of the offense by the prosecutors, or in the construction of it by the judges, as in common cases serve to limit the discretion of courts in favor of personal security. There will be no jury to stand between the judges who are to pronounce the sentence of the law, and the party who is to receive or suffer it.”

The constitutional case against putting Donald Trump on trial in the Senate after he leaves office as the means to disqualify him from holding a future public office is clear-cut. The Senate will be doing a great disservice to the country by fueling more dangerous political divisiveness while wasting valuable time and resources in the process.

It’s breathtaking, but we’re on the eve of the communist takeover of the United States of America. It has been a sickening, disgusting takeover, an almost five-year-long criminal coup led by enemies within our nation, hell’s children who love to make lies, just like their father the devil.

Yes, we lawfully re-elected President Trump in a landslide, and yes, in the dead of night the morning after Election Day, freedom-hating evildoers conspired to pull off the biggest election heist in our nation’s history. I can imagine the kinds of terror tactics that were used afterward against courts, judges, and political officials, resulting in their refusal, almost to a man, to even hear the overwhelming evidence of massive election fraud that was witnessed and discovered.

We had close to a year-long preview of some of the likely terroristic threats with the feral demoniacs of Black Lives Matter (BLM) and Antifa as they killed, stole, and destroyed. This included the Antifa/BLM infiltrator/provocateurs at the Patriot rally in Washington on January 6th who planned and executed the violent breach of the Capitol building. Yes, they did the violent incursion, not the peaceful Patriots. And, of course, the President had nothing at all to do with it. The communist Democrats and quisling Republicans darned well know it, too.

People in positions of authority who had the power to let the light shine on the evidence and render a proper judgment on the stolen election wanted no part of being targeted by those drunk-on-violence junior anarchists, so they did the wrong thing and let the stolen election stand.

Whatever the true number of voters for President Trump is, we are a large majority of the American people who voted. We know that President Trump has been a God-send, giving us a blessed four-year reprieve on the road to tyranny that our nation has been steadily traveling for many years now. We know the relentless assault against him by the children of hell – the purely insane, vicious attacks, lies, charges, and schemes, all meant to destroy him, his family, and anyone who would dare support him. But we easily see through it all, never wavering in our love, support, and deep appreciation for him.

We know that President Donald J. Trump has been a President of the ages, the best our nation has had since the beginning. His accomplishments and the good things he has done for our nation and allies are excellent and numerous. His policies led to a roaring economy, a grand tax cut, record-breaking low poverty and unemployment rates, American energy independence, and so much more. He ditched countless unAmerican policies of previous administrations. He honored Israel and Jerusalem. He honored the Lord, innocent life, and the freedom of worship. The long list of goodness goes on and likely would’ve continued in his second term.

Then came the planned weaponization of a flu-like virus (one with a near-100 percent recovery rate) to impose despotic control over people and destroy the economy, countless small businesses, and the lives of untold millions everywhere. This was the final phase of the coup against President Trump and the beginning of the ushering in of the global communist order they’re now calling The Great Reset. The darkest, most evil days of our nation and world are flying toward us.

At the start, our country’s Founding Fathers established the United States of America on the righteous foundation of godly principles and under God’s providence. The men who signed the Declaration of Independence truly and fully pledged all they had and all they were—their lives, fortunes, and sacred honor—in pursuit of freedom. They were men of means, and in the subsequent terrible times, they had to make good on their pledge. Many made enormous sacrifices.

Unlike any American President since our founding, President Trump willingly pledged his life, fortune, and sacred honor to the service of this nation that he dearly loves. He has already given so much, and it remains to be seen how much more the reprobate people now in power may try to take from him.

Those of us who call on the name of the Lord must continue to hold up in prayer President Trump and his family, to pray that the Lord will greatly protect them and continue to thwart the demented hate-mongers who plot evil against him; that their wicked designs will be turned back on their own heads; that President Trump will be safe, saved, and free in God’s great, caring hands.

And again, I close with continuing mega-prayers, love, and appreciation for Rush.



Pro-Sodomy Female Preacher Joins Southern Baptist Leader in Call for Trump Impeachment

Earlier this week, Reformation Charlotte reported that Russell Moore, a Democrat and the head of the Southern Baptist Convention’s Ethics and Religious Liberty Commission, was leading the Evangelical charge to call on Congress to impeach Donald Trump. The George Soros-linked Russell Moore wrote in an email communication that if he were a Senator, he would vote to convict Donald Trump of charges for inciting violence — a completely absurd charge.

Now, other leftists and pro-homosexual church leaders are joining Moore in his anti-conservative cause calling for the frivolous impeachment of Donald Trump to be upheld.

Among them is pro-sodomy, pro-abortion United Methodist General Secretary of Church and Society, Susan Henry-Crowe, who issued a statement in support of the impeachment and calling on Congress to bar him from ever holding office again.

“I, as General Secretary, support the U.S. House of Representatives’ impeachment of President Donald J. Trump,” she writes, “and urge the Senate to convict and bar him from ever holding public office again.” Citing absurd claims of racism and anti-Democratic sentiments, she continues, “The president bears responsibility for inciting this mob riot. Words were weaponized into violence last week, but the seeds had been sown years before.”

Of course, it should come as no surprise that a president who has governed further to the right than any president in modern history would be a threat to the continued leftward drift of progressive church leadership like Moore and Henry-Crowe.

Moore’s call for impeachment prompted one prominent seminary professor to call for the removal or resignation of Moore from his own office, as he does not represent the majority of people in the Southern Baptist Convention, yet, he continues to set himself up as the spokesperson for the Evangelical Church and uses his platform to promote his own leftist agenda.

 

Top Southern Baptist Leader Says If He Were Senator, He Would Vote to Impeach and Convict Donald Trump

Russell Moore, head of the Southern Baptist Convention’s Ethics and Religious Liberty Commission — a George Soros-linked front group for the Evangelical left — is arguably the most controversial figure in the American Church. That Moore, who spends denominational resources fighting for open borders, amnesty, and lobbying governments to build Islamic mosques, has somehow managed to hang on to this top leadership position despite calls from multiple angles for his resignation.

In a recent email communication, Russell Moore called for the impeachment of Donald Trump. But he didn’t stop there, he said that if he were a senator, he’d impeach Trump and vote to convict him — and that he’d be willing to risk losing his Senate seat to do so.

After making a ridiculous and unfounded case that, somehow, the president — who called unarguably called for peaceful protesting — incited a “violent” “insurrection,” he writes,

You don’t have to agree with me. I might be wrong. I don’t speak for anyone else, only myself. But you deserve to hear from me what I honestly think. If I were the President, I would resign. If I were the Vice President, I would assemble the cabinet in accordance with the 25th Amendment. If I were a Member of Congress, I would vote to impeach. And if I were a United States senator, I would vote to convict. And I would be willing, if necessary, to lose my seat to do so. As a matter of fact, I am willing, if necessary, to lose this seat. 

Russell Moore is the primary cause of division in the Southern Baptist Convention. Had it not been for Moore’s divisive and continuous rhetoric against conservatives in the denomination, we would not see such animosity toward each other. Before Trump’s election in 2016, Moore continuously railed against the president prompting a response from the then-presidential candidate,

If Trump has been wrong about everything else, he is absolutely right about this — Russell Moore does not represent truly conservative Evangelicals. Russell Moore is a divisive man, he needs to be purged. Earlier, one prominent seminary professor called on him to be removed. The entire Southern Baptist Convention needs to stand with him in this call.

Hundreds of Central Americans — many with families in tow — have begun the journey to the U.S. border hoping the new president will allow them to claim refugee status and enter the United States.

They will likely be stopped in Mexico thanks to coronavirus restrictions, but the incoming Biden administration is worried that this is only the beginning. Joe Biden’s campaign rhetoric promised a “more humane” immigration policy and expanded the number of those able to claim refugee status. This will inevitably lead to a massive influx of those seeking asylum at the border.

On Thursday, Guatemala cited the pandemic in order to declare emergency powers in seven border provinces migrants frequently transit through en route to Mexico. The measures limit public demonstrations and allow authorities to disperse any public meeting, group or demonstration by force.

Honduras and Guatemala have announced they will deploy thousands of soldiers to preemptively stop caravan members, while Mexico also deployed agents to its southern border on Thursday.

Both nations cooperated with the Trump administration in 2019 to limit the flow of migrants coming to the U.S. — largely because they were threatened with sanctions by Trump. But it worked. The crisis at the southwest border eased considerably.

Now the whole ugly mess threatens to start up again. Biden will be under enormous pressure to treat the migrants “humanely” at the border, which includes allowing them to cross into the United States. They won’t be detained. They will be allowed to go into the interior to wait 3-5 years for their hearings before an immigration judge.

The migrants say they are escaping poverty, unemployment, and gang and drug violence, as well as the aftermath of two violent hurricanes that hit the country last November.

But Washington has warned the migrants against making the journey, especially at the height of the coronavirus pandemic.

“This is a deadly journey — the US Border Patrol recovered more than 250 bodies along the US-Mexico border last fiscal year,” Mark Morgan, acting Commissioner of the US Customs and Border Protection, said in a statement last week.

At least Guatemala is taking some precautions to prevent people infected with the virus into their country.

Guatemala’s government has warned that anyone wanting to pass through its territory must show a negative coronavirus test and have their papers in order.

Mexico’s consulate in San Pedro Sula, from where caravans usually leave, warned that its government “does not encourage and will not allow the illegal entry of caravans.”

That may change as Biden’s “more humane” approach to immigration takes shape. Mexico especially would like nothing better than to ease pressure on its economy and institutions by allowing as many people as possible to leave for the United States. With no punitive measures taken by Biden to discourage it, it’s likely that caravans and a big increase in illegal border crossings will become a reality.

 

Trump to Declassify Trove of Obamagate Documents

With less than a week left in office, President Trump is declassifying a “massive trove” of FBI documents relating to Obamagate, including FBI documents “showing the Russia collusion story was leaked in the final weeks of the 2016 election in an effort to counteract Hillary Clinton’s email scandal,” reports Just The News

The documents could be released as early as Friday, and are said to include “FBI interviews and human source evaluation reports for two of the main informants in the Russia case, former MI6 agent Christopher Steele and academic Stefan Halper.”

According to government officials who spoke with Just The News, the internal FBI and DOJ documents pending release “detail significant flaws in the investigation and provide a detailed timeline of when the FBI first realized the Steele dossier was problematic.”

One bombshell revelation contained in the documents is an admission by Christopher Steele, who was hired by Clinton’s campaign law firm to dig up dirt on Trump. He leaked information from his controversial dossier to the media, such as the false Russian collusion narrative, in the final weeks of the 2016 presidential campaign to counter the Hillary Clinton email scandal, after former FBI Director James Comey had reopened the Clinton email investigation.

Several investigations have since concluded that the Steele dossier was mostly debunked and uncorroborated accusations, and likely contained Russian disinformation. Nevertheless, the dossier set off the biggest and most expensive political witch hunt in history.

The news comes on the heels of the House of Representatives impeaching President Trump a second time over accusations that he incited violence at the U.S. Capitol.

Rep. Boebert Votes “NO” on Impeachment Charade

“Impeachment isn’t a tool that should be used to virtue signal. But that’s exactly what occurred this week. Democrat hypocrisy was on full display with their article of impeachment, censure bills, an unconstitutional 25th Amendment removal attempt, and other attacks to try and punish Republicans for false accusations of inciting the type of violence Democrats have so frequently and transparently supported in the past.

“I voted against today’s article of impeachment and yesterday’s 25th Amendment coup, because these impeachment attempts were not exercised appropriately and because more partisan charades are not what our country needs right now. Rather than supporting these made-for-tv exercises, I urged the House to focus on reopening our economy and supporting America’s small businesses and working families.”

Yesterday, the House of Representatives voted on a resolution urging Vice President Pence to invoke the 25th Amendment to remove President Trump from office. This occurred after the Vice President came out and said he would not initiate the proceedings at the urging of Congress because it was inconsistent with the Constitution. The House of Representatives does not have the authority to initiate these proceedings. Furthermore, this resolution was inconsistent with the intent of the 25th Amendment as the 25th Amendment was ratified for situations where a President was severely disabled or incapacitated to the extent that he was incapable of carrying out his duties over an extended period.

Today, the House of Representatives took up a single article of impeachment that accused President Trump of inciting violence against the Government of the United States. The Senate Parliamentarian made clear that the Senate could not act on this article of impeachment until the day before President Trump leaves office.

At the rally where House Democrats falsely claim the President incited violence and started a coup, the President said, “We’re going to walk down to the Capitol, and we’re going to cheer on our brave senators and congressmen and women, and we’re probably not going to be cheering so much for some of them. I know that everyone here will soon be marching over to the Capitol building to peacefully and patriotically make your voices heard.”

The President, Rep. Boebert, and other House Republicans have all condemned those who broke the law and stormed the Capitol on January 6th, made clear that they do not represent the America First movement, urged prosecution for these unlawful acts, and promised an orderly transition in just a few short days on January 20th.

Disingenuous politics like the partisan Democrat bills the House took up this week only further divide the country and distract from the real issues we should be focused on.

According to the University of California, Santa Cruz, more than 317,000 businesses closed their doors from February to September. Tens of millions of jobs have been lost due to overreaching and often unconstitutional COVID policies that have unfairly targeted certain businesses and individuals.

Hard-working American families have lost their life savings and everything they own. Their struggles are real and their stories are heartbreaking. As a small business owner, Rep. Boebert understands these challenges and is focused on safely reopening our economy and fostering an environment for job creation.

The infamous Reichstag fire on Feb. 27, 1933. The government used it as a pretense to jail political enemies and strip away everyone's civil liberties. It's starting to seem frighteningly familiar.

Conservatives are suddenly living a political nightmare similar to the aftermath of the Reichstag fire in Germany in 1933. Following that arson on the German Parliament building, several thousand political opponents were jailed and the entire country was officially stripped of virtually every civil liberty. Those developments cemented the continued rise of Hitler and the Nazis. We all know what horrors followed.

The incident last week at the U.S. Capitol is minuscule in comparison to the extreme violence, deaths, and billions of dollars of damage brought on across America by the Black Lives Matter and Antifa riots. Moreover, the breach of the Capitol was clearly organized and led by Antifa types, according to eyewitnesses and counter-terrorism experts we’ve talked to personally and startling accounts we’ve read and seen.

Like the Reichstag fire, the incident at the U.S. Capitol is being used as an excuse by government, corporations, and the media to inflame an unprecedented war against conservatives. People who even dare to question the election results are being fired from their jobs across America. Conservative groups of all stripes are being denied service by technology companies. Banks are stopping service to Trump companies and others. The media has become a non-stop propaganda machine, attacking facts they don’t like as “lies.” Biden’s people are preparing even more extreme measures, including Second Amendment challenges and even gun confiscations. The FBI is now engaged against conservatives in one of the biggest phony “investigations” of its history. And we’re seeing the total militarization of D.C. – possibly to fuel fear of “patriots.” 

The mainstream conservative and Republican reaction to all this is disturbing. The general message we’re getting has been to back off, “go gray,” and try not to attract any more attention from the hysterical Leftist mob. Don’t provoke them. Hide and hope they’ll leave you alone. The American Thinker site, for example, has announced it has turned off its comments section for that reason. Will this strategy work – or just make things worse? Unfortunately, experience shows that cowering only emboldens the mob.

And it’s worse in Washington, DC. As we’ve seen this week, Republicans in Congress are surrendering in droves, abandoning their constituents, and some even jumping on board with the Democrats. At the impeachment “debate” on Jan. 13, there was no real pushback against the narrative that “Trump supporters” were behind the Jan. 6 riots. Is that an intelligent strategy?

In 2005, our MassResistance Banquet featured Stephan Ross as the keynote speaker. Ross was a Jew born in Poland. He was a survivor of ten Nazi concentration camps including Auschwitz. He was a great supporter of our organization, a personal friend of MR Director Brian Camenker, and was eager to share his wisdom.

He implored our group not to give up our aggressive activism. He said that the kinds of things that we were fighting at the time – violations of the constitution, graphic sex education, the LGBT agenda in the schools, “gay” marriage, abortion – were just the beginning of worse things to come. He said that if good people don’t stand up when they can, early on, the time will come when they can’t anymore.

In America, we can still rise up, though it’s becoming difficult with the increasing unlawfulness, censorship, and demonization by the Left. The Left is oppressive but not murderous – yet. We must ignore our fears and charge forward, or that will surely follow.

Like Martin Luther King’s organization in Birmingham, a group of fearless people can take down a seemingly unbeatable, overwhelming combination of government, business, and media –  if they refuse to give up.

Mr. Ross passed away last year. We got to know him very well, and he left an indelible mark on our psyche – and inspired us to carry on no matter the odds.

The point is to keep the truth alive and fight for what is right! This is how to construct the foundation for a future victory.

Fanatical Dems impeach President Trump for the second time --

and again without evidence.

With mere days before a new president takes office, leftist Democrats and useful-idiot Republicans voted Wednesday to impeach President Donald John Trump on false grounds for a second time, a move that places the United States on a fast-track toward banana-republic status.

The vote to impeach on January 13 was 232 to 197. Ten Republican lawmakers voted to betray their own party and impeach President Trump.

They are: Adam Kinzinger of Illinois; Liz Cheney of Wyoming; John Katko of New York; Fred Upton of Michigan; Jaime Herrera Beutler of Washington;  Dan Newhouse of Washington; Peter Meijer of Michigan; Anthony Gonzalez of Ohio; Tom Rice of South Carolina; and David Valadao of California.

The reason why they did this is clear: despite everything that has happened, Trump’s voters are standing by him. That makes him a threat –not to the republic, as the Left claims— but to the deep state-globalist-socialist-communist alliance that in a few days will control both the executive and legislative branches of the federal government. They want Trump out of the picture so things can return to so-called normal. Even if they can’t get the impeachment trial underway in the Senate before Trump leaves office at 12 Noon on January 20, they want the Senate to convict the president and bar him from seeking office again. Some legal scholars, though, notably not Alan Dershowitz, say a president leaving the office does not deprive the Senate of jurisdiction to hear the case.

As much as it pained the often-manic Frank Luntz, the Trump-hating pollster, to admit, “Despite their criticism of his conduct since November 3rd and last week, 91% of Trump voters say they’d still vote for him if another presidential election were held today.”

“73% of Trump voters still say the election system is ‘rigged,’ even after being reminded that Trump and his allies lost more than 60 cases in court challenging election results,” a glum Luntz wrote January 11 in a tweet.

In addition, 78 percent of the respondents said they agreed with the president’s claim that the election was “stolen” from him, and 67 percent said Trump would be the winner if the votes were “counted accurately and fairly.”

So after everything the anti-Trump conspirators and the universe have thrown at the president since his wild ride began on the escalator at Trump Tower in Manhattan on June 16, 2015 –including but not limited to claims of racism, white nationalism, sexism, sexual abuse, ripping off customers, investors, and creditors, Spygate, Hillary Clinton’s phony Russian dossier and the never-ending fantasies of Russian collusion in the 2016 election, Charlottesville unrest and the lie that he praised neo-Nazis, sanctuary cities and states, Antifa riots, Black Lives Matter riots, Capitol Hill Autonomous Zone (CHAZ) riots in Seattle, tax allegations, claims of being a greedy businessman, claims of being an incompetent businessman, social media totalitarianism, claims of illegal emoluments, porn stars and models, dishonest fact-checkers, COVID-19, and the innocent conversation with Ukraine’s president that got him impeached the first time— Trump is still riding high in the eyes of his base.

Combine all of that with the legions of disloyal, pearl-clutching, backstabbing appointees and associates such as departed FBI Director James Comey, White House communications officials Anthony Scaramucci, Alyssa Farah, Stephanie Grisham, Ambassador Mick Mulvaney, Education Secretary Betsy DeVos, uncomfortably-close -to-the-Chinese-Communists Transportation Secretary Elaine Chao, Acting DHS Secretary Chad Wolf, kooky Defense Secretary James Mattis, treacherous National Security Adviser John Bolton, and troublemaking nonentities like Omarosa Manigault, and it is truly amazing that Trump has survived in office this long.

The impeachment vehicle this time was House Resolution 24, which was introduced in the House of Representatives January 11. It is a series of lies, half-truths, and political spin.

The single article of impeachment states that Trump “engaged in high Crimes and Misdemeanors by inciting violence against the Government of the United States.”

The resolution continues, stating that in the months preceding the January 6 joint session of Congress convened to count the votes of the Electoral College, “President Trump repeatedly issued false statements asserting that the Presidential election results were the product of widespread fraud and should not be accepted by the American people or certified by State or Federal officials.”

Not long before the joint session got underway, Trump addressed a crowd at the Ellipse outside the White House and “reiterated false claims that ‘we won this election, and we won it by a landslide.’”

Trump “also willfully made statements that, in context, encouraged—and foreseeably resulted in—lawless action at the Capitol, such as: ‘if you don’t fight like hell you’re not going to have a country anymore.’ Thus incited by President Trump, members of the crowd he had addressed, in an attempt to, among other objectives, interfere with the Joint Session’s solemn constitutional duty to certify the results of the 2020 Presidential election, unlawfully breached and vandalized the Capitol, injured and killed law enforcement personnel, menaced Members of Congress, the Vice President, and Congressional personnel, and engaged in other violent, deadly, destructive, and seditious acts.”

“President Trump’s conduct on January 6, 2021, followed his prior efforts to subvert and obstruct the certification of the results of the 2020 Presidential election. Those prior efforts included a phone call on January 2, 2021, during which President Trump urged the secretary of state of Georgia, Brad Raffensperger, to ‘find’ enough votes to overturn the Georgia Presidential election results and threatened Secretary Raffensperger if he failed to do so.”

In fact, Trump didn’t demand that Raffensperger tamper with election results or threaten him. A leaked recording of the telephone call revealed that Trump merely informed Raffensperger, a fellow Republican, of how many votes the president needed to win Georgia.

"I just want to find 11,780 votes," Trump said.

“In all this, President Trump gravely endangered the security of the United States and its institutions of government,” the resolution absurdly states.

“He threatened the integrity of the democratic system, interfered with the peaceful transition of power, and imperiled a coequal branch of Government. He thereby betrayed his trust as President, to the manifest injury of the people of the United States.

“Wherefore, Donald John Trump, by such conduct, has demonstrated that he will remain a threat to national security, democracy, and the Constitution if allowed to remain in office, and has acted in a manner grossly incompatible with self-governance and the rule of law. Donald John Trump thus warrants impeachment and trial, removal from office, and disqualification to hold and enjoy any office of honor, trust, or profit under the United States.”

The Kafkaesque resolution, in effect, criminalizes following existing lawful processes for disputing elections and deprives the president of his free speech rights by characterizing legitimate means of participating in public debate as somehow illicit.

It strangely argues that Trump telling supporters at a pep rally to “fight like hell” was an example of incitement. Of course, the Democrats don’t bother to provide a legal analysis explaining their theory that telling someone to “fight” constitutes incitement because they can’t.

“Incitement” has a specific legal definition in the Supreme Court’s landmark 1969 ruling in Brandenburg v. Ohio. The conduct complained of must be both “directed to inciting or producing imminent lawless action” and be “likely to incite or produce such action.”

As I previously showed, the president did not incite violence in his speech. If anything, he urged his supporters at the rally in question to remain calm and peaceful.

The resolution also fails to take into account that Biden’s come-from-behind victory after Trump was solidly ahead in battleground states the morning after Election Day, was a statistical impossibility.

Economist Charles J. Cicchetti calculated that “[t]he probability of former Vice President Biden winning the popular vote in the four Defendant States—Georgia, Michigan, Pennsylvania, and Wisconsin—independently given President Trump’s early lead in those States as of 3 a.m. on November 4, 2020, is less than one in a quadrillion, or 1 in 1,000,000,000,000,000.”

For Biden “to win these four States collectively, the odds of that event happening decrease to less than one in a quadrillion to the fourth power,” according to a brief Texas filed with the Supreme Court last month in an unsuccessful attempt to challenge the election results in battleground states.

But facts don’t matter to radicals who view truth as subordinate to politics.

Massachusetts Democrat and socialist Jim McGovern, chairman of the House Rules Committee, opened debate in the House by declaring, “We are debating this historic measure at an actual crime scene," a reference to the fact that apparent Trump supporters and Antifa ran amok in the chamber, forcing those inside to take cover.

McGovern said Congress was disrupted as it carried out one of its key responsibilities, certifying the election.

"But at a rally just a mile and a half down Pennsylvania Avenue, Donald Trump and his allies were stoking the anger of a violent mob," McGovern said. "A member of this very body proclaimed on that stage, ‘Today is the day American patriots start taking down names and kicking ass,’” a reference to a rally speech delivered by Rep. Mo Brooks, an Alabama Republican.

"Trump told the crowd, 'We're going to have to fight much harder. You will never take back our country with weakness,’” McGovern said, quoting Trump’s completely ordinary, perfectly lawful political rhetoric.

"The symbol was unmistakable. These thugs should stage a coup, so Donald Trump can hang on to power, the people's will be damned. This beacon of democracy became the site of a vicious attack,” the congressman said.

No one, including McGovern by the way, has ever bothered to explain how capturing the Capitol during the counting of the electoral votes, if that’s what those who ran amok in the complex planned to do, would constitute a coup. Without control of the armed forces and police, it is difficult to imagine any raiders seizing control of the government and making it do what they desire. Real coups can be quite complex. Even if they had taken, say, Vice President Mike Pence and other elected officials hostage, that wouldn’t have prevented the government from functioning. So the coup theory has many holes in it.

McGovern’s rhetoric doesn’t need to be logical; just plausible-sounding.

He thinks that he can take plain words and expressions that people routinely use in politics and make them seem sinister, turning them into magical words capable of making a mob of Trump supporters angry enough to storm a building.

"This was not a protest,” McGovern said. “This was an insurrection,” he said, ignoring all the damage Antifa and Black Lives Matter inflicted on American cities over the past year.

“This was a well-organized attack on our country that was incited by Donald Trump. Domestic terrorists broke into the United States Capitol that day, and it's a miracle more people didn't die. As my colleagues and I were being evacuated to safety I never, ever will forget what I saw when I looked into the eyes of those attackers right in the speaker's lobby there. I saw evil, Mr. Speaker.”

Or maybe McGovern and his fellow America-hating radicals were looking in a mirror.

 

YouTube Suspends President Trump’s Channel

YouTube Becomes Latest to Censor Trump, Citing "Potential for Violence"

The purge continues.

The Google-owned video-sharing platform YouTube on Tuesday placed a temporary suspension on President Donald Trump’s account, preventing the president from uploading new content for a week.

“After review, and in light of concerns about the ongoing potential for violence, we removed new content uploaded to Donald J. Trump’s channel for violating our policies,” YouTube said in a statement Tuesday night.

“It now has its 1st strike & is temporarily prevented from uploading new content for a *minimum* of 7 days,” the company continued.

If a content creator gets three “strikes” within a 90-day period, his or her channel will be permanently banned from the platform.

“Given the ongoing concerns about violence, we will also be indefinitely disabling comments on President Trump’s channel, as we’ve done to other channels where there are safety concerns found in the comments section,” YouTube added.

This comes amid the effort by various social-media companies to censor or ban the president on grounds that his words “incite violence,” a claim allegedly evidenced by the march on Congress last week, in which a crowd entered into the Capitol Building without authorization.

Following those events, the social media platforms Facebook, Instagram (which is owned by Facebook), and Twitter banned President Trump.

The suppression of the sitting American president prompted major migration of users to the free speech-focused Parler, but within a few hours, Google (which developed the Android smartphone operation system) and Apple banned Parler from their app stores, making it harder for people to access it on their phones.

Of course, users could still find Parler on their smartphone or computer browsers, but then Amazon, whose hosting services Parler was using, cut the alternative platform off, knocking it offline until the company can find a new host.

Another tech firm to abruptly end its relationship with the president over last week’s events at the Capitol is Stripe, one of the most popular online payment-processing platforms.

Stripe’s decision to blacklist the Trump campaign means the president’s team is unable to accept credit-card donations.

Similarly, Shopify, the online platform being used by TrumpStore.com, which is run by the Trump campaign and Trump Organization, terminated access by the president’s team.

“Shopify does not tolerate actions that incite violence. Based on recent events, we have determined that the actions by President Donald J. Trump violate our Acceptable Use Policy, which prohibits promotion or support of organizations, platforms or people that threaten or condone violence to further a cause. As a result, we have terminated stores affiliated with President Trump,” Shopify said in a statement.

For the global elites, everything is marching according to plan. They control Big Tech and are now unleashing the full capacity for social control for which they invested billions of dollars.

While these widely influential platforms purge the president and his supporters, making the diffusion of truth more challenging, the leftist media is cheering.

The outlet Axios best articulated the goal of the left (albeit in glowing terms) by calling leftist corporations, particularly Big Tech, a “4th branch of government” more efficient and powerful than the White House or Congress.

This is a perilous moment for freedom of speech, and not only in the sphere of social media. The establishment has shown that they are willing to use whatever industry they control to silence political dissidents. Are you guilty of “right-wing hate speech?” The major social media sites will ban you. The major telecom firms will take down your websites. Soon all the major banks will shut down your account, and even if you use a local credit union, Visa and Mastercard will blacklist you so you can’t use cards.

Sadly, most major corporations in every industry, certainly nearly all the multinational conglomerates, work with the global elites because they became successful thanks to the investment of older generations of globalists.

Companies such as Facebook, Twitter, and Google didn’t get big in a vacuum, but they received several rounds of capital investment prior to going public. The establishment wouldn’t have given them that money if they weren’t assured the likes of Mark Zuckerberg and Jack Dorsey would bow before the globalist agenda once rising to prominence.

Nevertheless, patriots must continue to create their own communications platforms if they wish to be free from the influence of the establishment. That includes using their own servers so they can’t so easily be taken offline. And even if the social-media options run out, patriots can count on sites such as The New American to continually have truthful reporting on what’s happening in the country.

We cannot give up; winning the information war is crucial to winning the war for America.

 

Here’s the List of Powerful Companies Cutting Off Trump and His Supporters After Capitol Siege

The list is getting longer of corporations cutting ties with President Donald Trump and his friends and allies because of the January 6th incursion of the US Capitol Building.

A huge Save America rally supporting the president was held at the Ellipse.  The four hour long rally with multiple speakers culminated with the president’s more than hour long speech and a planned march to the U.S. Capitol Building for an apparent rally there. Inside, the Congress was discussing the results of the Electoral College vote. Allies of the president attempted to forestall the certification of the election by asking for a ten-day audit of the troubling results from states believed to have experienced electoral fraud.

A break-away bunch of free radical Trump supporters and others, including at least one Leftist, fought their way into windows and doors or were allowed into the Capitol Building by law enforcement. Some people simply walked through the building from one entrance and exiting another. Others stuck around to do some chest beating and breaking objects and stealing things from private congressional offices.

Members of Congress were evacuated wearing gas masks.

It was abominable.

While it’s convenient to blame a president the Left already can’t stand, as I’ve reported at PJ Media, it’s very difficult to make a case that the president’s words fomented the unrest. Former federal prosecutor Andy McCarthy has come to that conclusion as well, even after the shocked Fox News contributor said he believed the president incited the mob. Saying that is one thing, proving it is another.  Read the president’s words and watch them for yourself.

But, people predisposed to hating the president and hyper-sensitive to the sensitivities of the institutions run by the political Left have spoken. They’ve cut off the president, his friends, colleagues and, in some case, his fans. The New York Times reported a cohort of companies from banks to health care companies are temporarily halting their PAC giving to any political parties.

The following is a list of companies that have cut off the president and/or friends or political party is culled from various news stories, among them from AxiosThe New York Times, the Associated Press and other publications.

Amazon

Amazon, one of the biggest companies in the world, owned by the richest man in the world, who also owns The Washington Post, cut off donations to Republicans who fought election fraud and demanded an extension of the voting in the Electoral College.

Golf

Professional Golf Association of America

The PGA has cut its ties with the Trump organization, owner of multiple golf clubs and resorts. The PGA reneged on its agreement to hold the 2022 PGA Championship at Trump’s Bedminster golf course. The New York Times reports that the PGA president claimed the Trump association “would be detrimental to the P.G.A. of America brand, and would put at risk the P.G.A.’s ability to deliver our many programs, and sustain the longevity of our mission.”

High Tech/Social Media

Facebook

Facebook has banned President Trump from posting on its platform.

Twitter

Twitter has permanently banned the president from its platform.

Shopify

Shopify, an e-commerce company, has dropped the Trump campaign and Trump Organization from its platform permanently.

Stripe

Stripe, an online payment company, has dropped the president because it claims he encouraged violence.

Reddit

Reddit  cut off the sub reddit handle r/DonaldTrump due to Stop the Steal discussions.

Snapchat

Snapchat cut off the president’s account. It muted the account in June.

Twitch

Twitch has locked out President Trump of its Minority Report-like standard which is he might incite violence

Academia

Lehigh University

Lehigh University, which gave Donald Trump an honorary degree in 1988, withdrew it.

Wagner College

Wagner College withdrew its honorary degree it awarded the president in 2004.

Middlebury College

Vermont’s uber liberal Middlebury College is considering revoking Rudolph Giuliani’s honorary law doctorate, given for his valiant response to 9/11, but they don’t like him anymore.

Banks/Finance

American Express

The NYT reported the American Express PAC would no longer support any Congressional member who voted against certifying the election. The company never supported any GOP Senators according to The New York Times. There’s no word on if the company cut off Democrats who have voted against certification in the past.

The investment giant has cut off donations to any congressional member who voted against certifying the election.

New York State Bar Association

The liberal New York State Bar Association is considering investigating Giuliani and banishing him from their group.

Telecom/Cable

AT&T

The Dallas based media and telecom company withdrew all its PAC donations from all Republicans including 17 Texas state Republicans and Senator Ted Cruz. A group called End Citizens United called for the corporation’s withdrawal of donations from Republicans. It owns Time Warner cable.

Comcast

Comcast announced it’s cutting off Republicans who fought the election results. Comcast owns NBCUniversal, NBC TV, local NBC stations, Xfinity, Telemundo, not to mention film companies and recreational parks.

Manufacturing

Dow Chemical

Dow Chemical, the Michigan based-chemical and plastics company, announced it would cut off Republicans who didn’t support Joe Biden’s Electoral College victory. The multinational corporation announced that it would suspend donations for the next election cycle.

Insurance

Blue Cross Blue Shield

Blue Cross Blue Shield Association cut off political contributions to Republicans who tried to stop the certification of the Electoral College. It’s “one of the nation’s largest federations of insurance companies,” according to The New York Times.

Hospitality

Marriott International

The hospitality company Marriott International, which besides its own eponymously named hotels owns nearly 5,400 other properties, including the luxe The Ritz Carlton brand, Autograph Collection Hotels, St. Regis and many others, says it’s cutting off the GOP because of the “destructive events at the Capitol” which undermined “a legitimate and fair election.”

Publishing/Media

Hallmark

Hallmark has asked Senators Josh Hawley and Roger Marshall to give back their campaign contributions for voting against certifying the election. Hallmark owns publishing, television networks, retail stores, and even the Crayola art materials company.

Cumulus

The radio station group reportedly put its conservative hosts on notice that they not give oxygen to the idea that the election wasn’t over. National Review reports the brass at Cumulus put out a memo reading, “We need to help induce national calm NOW,” Cumulus’s executive vice president of content Brian Philips wrote in the memo. The company “will not tolerate any suggestion that the election has not ended. The election has been resolved and there are no alternate acceptable ‘paths.’”

Cumulous stations host Mark Levin, Ben Shapiro, and many other conservative hosts across the country.

Other Companies Halting All Political Donations:

The New York Times reports that the following companies also plan on halting all political donations from their political action committees for the foreseeable future.

They are JPMorgan Chase, Facebook, Goldman Sachs, Citigroup, Morgan Stanley, Visa, American Airlines, BP, and Coca Cola.

Airbnb and FedEx are studying their political giving before making any further announcements.

The shockwaves from the actions of those at the Capitol Building on January 6th will continue to ripple through a shocked public – a ripple felt all the way up to the glass-enclosed corner offices of corporations around the country.

Andrew Torba, the CEO of Gab, a free-speech alternative to Twitter, backed up President Trump’s entire account before it was deleted, and recreated it on Gab.

Gab is currently experiencing bandwidth issues over a surge in new users and attacks from liberal groups.

If Trump is looking to find a new social media platform, Torba seems to be nudging Trump to go to Gab, though it is not clear whether that is the reason behind the recreation of Trump’s Twitter account on the platform. The account has “Pro” status and states that the account was created in August 2016. The account does not follow any other accounts but has 1.2 million followers.

Last Thursday, one day after the deadly siege on the U.S. Capitol, Franklin Graham had a message for Americans.

"“The division in our country is as great as any time since the Civil War,” he tweeted. “I am calling on Christians to unite our hearts together in prayer for President-elect @JoeBiden and Vice President-elect @KamalaHarris, and for the leadership in both parties.”

It was the kind of statement this country needs to hear, a call for reconciliation that you’d expect from a faith leader. Except just two weeks before, this leader’s arms were folded, not open. “Many people believe the presidential election was stolen from @realDonaldTrump,” Graham tweeted on December 28, “and if conservatives lose control of the Senate, there is nothing to stop the radical agenda of the left.”

Earlier in December, Graham echoed the same election lies that fueled the Capitol invaders. “When he says this election was rigged or stolen,” Graham said of the president, “I tend to believe him.”

Less than a week has passed since the Capitol riot, and the Democratic Party, the establishment media, and Big Tech now present it as axiomatic that President Donald Trump incited the mob for the purpose of preventing the electoral vote certification and, presumably, grabbing dictatorial powers. Republican Senators Pat Toomey and Lisa Murkowski have joined the calls for Trump either to resign or face a second impeachment, and even Ted Cruz has said that Trump’s rhetoric “certainly contributed to the violence that occurred.” But before the lynch mob gets the noose ready and hangs the president from the nearest tree, it would be useful to step back and make sure that he really did what everyone seems to be sure he was guilty of doing: incite the crowd at the Capitol to violence for the purpose of staging a coup.

Trump’s speech that supposedly incited the mob is here. At the end of it, he said:

So we’re going to, we’re going to walk down Pennsylvania Avenue, I love Pennsylvania Avenue, and we’re going to the Capitol and we’re going to try and give… The Democrats are hopeless. They’re never voting for anything, not even one vote. But we’re going to try and give our Republicans, the weak ones, because the strong ones don’t need any of our help, we’re going to try and give them the kind of pride and boldness that they need to take back our country. So let’s walk down Pennsylvania Avenue. I want to thank you all. God bless you and God bless America. Thank you all for being here, this is incredible. Thank you very much. Thank you.

The attentive reader may have noticed that there is nothing there, or in any other part of the speech, calling upon the crowd to storm the Capitol, or to overthrow the government, or to do anything but walk down Pennsylvania Avenue and encourage lawmakers to support the president. The case for the claim that Trump incited the mob rests on the proposition that he didn’t have to spell out what he wanted them to do; when he detailed his reasons for believing that the 2020 presidential election was stolen, that was enough to inflame them sufficiently to storm the Capitol.

However, assuming that the crowd would have remained peaceful were it not for Trump’s criticism of the election is to embark upon an extremely dangerous path. To take for granted, as so many do today, that Trump incited violence by criticizing the election, is to commit the classic logical fallacy of post hoc ergo propter hoc, after this, therefore caused by this. It opens the door for criticism of anyone or anything to be labeled dangerous and inciting of violence, and silenced accordingly. Tyrants and would-be tyrants can silence criticism of their rule by claiming that their opponents, by engaging in that criticism, are inciting and inviting violence.

The path that the Democratic Party and Big Tech are taking leads straight to the silencing of the powerless by the powerful, and the criminalization of political dissent.

And so all Americans should these days be insisting: where and how, exactly, did President Trump incite the mob? Where did he say that the crowd should storm the Capitol and disrupt the electoral vote certification? If he didn’t say this, then he is not guilty of incitement, and to claim that he is threatens the very foundations of America as a free society.

There is an important precedent for this insistence on specific evidence. On May 11, 1846, President James K. Polk told Congress that Mexican troops had “invaded our territory and shed the blood of our fellow-citizens on our own soil.” The soil in question was actually between the Nueces and Rio Grande rivers in Texas, which at that time was disputed territory. And so a young Whig congressman named Abraham Lincoln introduced into the House the “Spot Resolutions,” taking issue with Polk’s claim that Mexican forces had killed Americans within the United States and asking the president to specify at what spot they actually did so. Lincoln found the support for Polk’s claims wanting, stating that the president could not deny and had not denied that the American troops had actually been the aggressors, and declared that “the war with Mexico was unnecessarily and unconstitutionally commenced.”

Lincoln’s resolutions were ignored. And another future president, Ulysses S. Grant, who fought in the Mexican War, stated in 1879: “I do not think there was ever a more wicked war than that waged by the United States on Mexico.” In 1885, he wrote that the Mexican War was “one of the most unjust ever waged by a stronger against a weaker nation.”

That war started in a frenzy of righteous anger that was so strong that no one bothered to check, as Lincoln requested, to see if the claims upon which it was based were true. Now Nancy Pelosi and Chuck Schumer are planning to impeach and remove Trump in the waning days of his presidency, and thereby, they hope, stigmatize and marginalize both him and his movement forever, but it is useful again to ask: when and how exactly did he do what they accuse him of doing? Grant thought that the Civil War was divine retribution for the injustice of the Mexican War; in likewise rushing forward without concern for niceties such actually proving their case, Pelosi and Schumer are taking us down a path that could have similarly calamitous results.

Freedom and democracy must be constantly guarded and protected, both abroad and from within.  We must always be skeptical of those who want conformity and control.  Even in free nations, we see alarming signs and new challenges to liberty.

A small number of social media platforms are acquiring immense power over what we can see and over what we are allowed to say.  A permanent political class is openly disdainful, dismissive, and defiant of the will of the people.  A faceless bureaucracy operates in secret and weakens democratic rule.  Media and academic institutions push flat-out assaults on our histories, traditions, and values.

In the United States, my administration has made clear to social media companies that we will uphold the right of free speech.  A free society cannot allow social media giants to silence the voices of the people, and a free people must never, ever be enlisted in the cause of silencing, coercing, canceling, or blacklisting their own neighbors.

On September 24, 2019, President Trump used part of his speech at the 74th Session of the United Nations General Assembly to warn of Big Tech’s expanding power and influence. The U.S. President argued that social media censorship is incompatible with a free society. He also denounced the growing and dangerous trend of “silencing, coercing, canceling, or blacklisting” citizens.

Fast forward sixteen months, Twitter permanently suspends President Donald Trump’s account and censors the official @POTUS U.S. Government account.

The Following Action Must Be Taken

Over the past several years, Twitter, Facebook and Google, have made it a regular practice to delete selective content and entire accounts without warning or rationale, leaving users without recourse. During the 2020 U.S. presidential election the tech giants led an unprecedented censorship campaign against the President of the United States and his supporters.

Over the past week, these platforms have taken their actions to yet another level with the permanent ban of the account of the President Trump. As reported previously at RAIR Foundation USA, While every media business is certainly free to choose the content it publishes and the editorial position it advances on issues including politics, typical media businesses can be held liable for libel and slander for publishing erroneous and damaging content.

These social media behemoths, however, have successfully categorized themselves as “platforms” and not media companies that create or publish content. As “platforms,” these tech giants have successfully positioned themselves as equivalent to passive bulletin boards facilitating discussions, and not the actual creator or curator of that content. Much like a wireless carrier who is not liable for what is spoken on their phone lines, social media platforms are supposed to be the means for neutrally distributing content produced by others. As a result, the social media companies are not responsible for what is said or published on their “platforms.”

Section 230 of the Communications Decency Act essentially provides an exemption to these “platforms” from the liability that all other media companies, including your local newspapers and tv stations, New York Times, Fox News, CNN, MSNBC and individual bloggers, must defend themselves from every day.

Examples like the deplatforming of President Donald Trump and countless other conservatives makes it crystal clear that these social media giants have crossed the line from passive distributors of content like a wireless cell phone carrier facilitating phone calls and entrenched themselves deeply as editorial content businesses advancing political agendas.

The ability of these social media companies to become editorial content businesses is completely within their rights and totally within their discretion. BUT, if they make the decision to become editorial content businesses, as they clearly have, then the laws of the United States should treat these companies should lose their liability shield and be exposed to potential liability like all other editorial content businesses such as Associated Press, Time Magazine, Bloomberg New or the Wall Street Journal.

Ironically, back in 2015, Twitter founder Jack Dorsey tweeted “Twitter stands for the freedom of expression. We stand for speaking truth to power. And we stand for empowering dialogue.”

The deplatforming of President Trump by Twitter and the countless examples of these “platforms” removing content or restricting access to their distribution channels makes it crystal clear that these social media giants have obliterated the line from passive distributors and entrenched themselves deeply as editorial content businesses advancing political agendas.

Social media companies must be treated in like manner to how all other media companies are treated with accountability through potential liability. Section 230 of the Communications Decency Act must be repealed – our freedoms under the constitution are dependent upon this.
