YouTube’s Chief Product Officer has insulted his own users as basement-dwellers who deserve to be relegated by the algorithm in favor of “authoritative” mainstream sources.Neil Mohan made the remarks during an interview with Protocol’s editor at large David Pierce after he was asked if YouTube had to switch its approach to moderating content given the ever changing advice of health authorities in relation to the coronavirus.Mohan said that this was the reason YouTube was “raising up authoritative voices,” which is a euphemism for suppressing voices that aren’t part of the mainstream media, despite the fact that the public’s trust in the media during the coronavirus pandemic has plummeted even further.He then went on to insult his own user base as basement-dwelling idiots.“As opposed to, you know, it’s somebody espousing their opinions about a mask, you know, in their basement,” said Mohan. “This is coming from an authoritative channel, a news source, a medical professional, and if that’s the case, we think there’s going to be some context that’s provided around the question of masks. Three US universities are responding to the coronavirus crisis by creating (irony of all ironies) a Chinese style social credit surveillance system that will ‘score’ people based on their exposure to the virus.According to a report from Tech site dot.LA, researchers at the University of Southern California, Emory University, and the University of Texas Health Science Center are jointly working on the system after receiving federal grant funding.Like the Chinese social credit system, the scheme will consist of a mobile app for contact tracing the virus, and promises to track the real-time location and symptoms of individuals to calculate “personal risk scores”.The score would be used to determine the need “for quarantine and decontamination,” according to the report, with “aggregate risk scores” also assigned to “locations like your neighborhood grocery store.”The universities hope to have a working mobile app by August, in time for the start of the fall semester.Welcome to the new normal. Surely the fallout of this system will all be positive.When the coronavirus vaccine eventually comes along the system will presumably be updated to show who has had it and who hasn’t.High social credit points for those who have taken it, no travel privileges for those who refuse!We’re in this together!The report notes that “Countries such as South Korea or China have used location-based digitized contact tracing. However, it has only been successful because citizens are forced to download it, opt into location monitoring, and regularly check in or otherwise be visited by enforcement authorities.”“In that setting where there’s 100% mandated compliance, it’s been shown it can work, in our setting in the United States, I don’t see that really happening,” said Dr. Jeffrey Klausner, a professor of medicine at UCLA.“We have enough problems with governors issuing orders and denying free personal movement, that the idea that people are going to be ordered to download apps to monitor their movement is highly unlikely and probably not constitutional.” Klausner added, conceding that “It’s going to be difficult to get Americans to agree to involuntary surveillance.”The report further notes that the social credit scoring could “become problematic if a school or employer requires students or workers reveal them as a condition of receiving a benefit, entering a building or returning to their office.”“When you introduce ‘scoring’ that takes other factors into account, it complicates everything, and increases the risk that users will be misinformed or discriminated against due to factors beyond their control,” noted USC’s Cyrus Shahabi, a professor of computer science.Indeed, the Chinese social credit system has reportedly blacklisted more than 13 million citizens as “untrustworthy,” state media recently bragged.And what heinous behaviour led to the distinction? Being familiar with history and a pessimist regarding the human condition, I never believed that.But the ease with which police state tactics have been employed and the equal ease with which most Americans have accepted them have been breathtaking.People will argue that a temporary police state has been justified because of the allegedly unique threat to life posed by the new coronavirus. I do not believe the data will bear that out. Regardless, let us at least agree that we are closer to a police state than ever in American history."Police state" does not mean totalitarian state. America is not a totalitarian state; we still have many freedoms. In a totalitarian state, this article could not be legally published, and if it were illegally published, I would be imprisoned and/or executed. But we are presently living with all four of the key hallmarks of a police state:No. 1: Draconian laws depriving citizens of elementary civil rights.The federal, state, county and city governments are now restricting almost every freedom except those of travel and speech. Americans have been banned from going to work (and thereby earning a living), meeting in groups (both indoors and outdoors), meeting in their cars in church parking lots to pray and entering state-owned properties such as beaches and parks — among many other prohibitions.No. 2: A mass media supportive of the state's messaging and deprivation of rights.The New York Times, CNN and every other mainstream mass medium — except Fox News, The Wall Street Journal (editorial and opinion pages only) and talk radio — have served the cause of state control over individual Americans' lives just as Pravda served the Soviet government. In fact, there is almost no more dissent in The New York Times than there was in Pravda. And the Big Tech platforms are removing posts about the virus and potential treatments they deem "misinformation."No. 3: Use of police.Police departments throughout America have agreed to enforce these laws and edicts with what can only be described as frightening alacrity. After hearing me describe police giving summonses to, or even arresting, people for playing baseball with their children on a beach, jogging alone without a mask, or worshipping on Easter while sitting isolated in their cars in a church parking lot, a police officer called my show. He explained that the police have no choice. They must respond to every dispatch they receive."And why are they dispatched to a person jogging on a beach or sitting alone in a park?" I asked.Because the department was informed about these lawbreakers."And who told the police about these lawbreakers?" I asked.His answer brings us to the fourth characteristic of a police state:No. 4: Snitches.How do the police dispatchers learn of lawbreakers such as families playing softball in a public park, lone joggers without face masks, etc.? From their fellow citizens snitching on them.The mayor of New York City, Bill de Blasio, set up a "snitch line," whereby New Yorkers were told to send authorities photos of fellow New Yorkers violating any of the quarantine laws. Los Angeles Mayor Eric Garcetti similarly encouraged snitching, unabashedly using the term.It is said that about 1 in every 100 East German citizens were informers for the Stasi, the East German secret police, as superbly portrayed in the film "The Lives of Others." It would be interesting, and, I think, important, to know what percentage of New Yorkers informed on their fellow citizens. Now, again, you may think such a comparison is not morally valid, that de Blasio's call to New Yorkers to serve a Stasi-like role was morally justified given the coronavirus pandemic. But you cannot deny it is Stasi-like or that, other than identifying spies during World War II, this is unprecedented in American history at anywhere near this level.This past Friday night, I gathered with six others for a Shabbat dinner with friends in Santa Monica, California. On my Friday radio show, I announced I would be doing that, and if I was arrested, it would be worth it. In my most pessimistic dreams, I never imagined that in America, having dinner at a friend's house would be an act of civil disobedience, perhaps even a criminal act. But that is precisely what happens in a police state.The reason I believe this is a dress rehearsal is that too many Americans appear untroubled by it; the dominant force in America, the left, supports it, and one of the two major political parties has been taken over by the left. Democrats and their supporters have, in effect, announced they will use state power to enforce any law they can to combat the even greater "existential" crisis of global warming.On the CNN website this weekend, in one of the most frightening and fanatical articles in an era of fanaticism, Bill Weir, CNN chief climate correspondent, wrote an open letter to his newborn son. In it, he wrote of his idealized future for America: "completely new forms of power, food, construction, transportation, economics and politics."You cannot get there without a police state.If you love liberty, you must see that it is jeopardized more than at any time since America's founding. And that means, among other things, that at this time, a vote for any Democrat is a vote to end liberty.

Last month, California governor Gavin Newsom signed an executive order for “all-mail” ballots for elections in May and June. In similar style, Democrats in Congress have been pushing for ballots to be mailed to every registered voter for the November election. What could possibly go wrong? Consider the California experience, starting back in 2004.Proposition 71, the California Stem Cell Research and Cures Initiative featured Christopher Reeve, Brad Pitt, and Michael J. Fox touting life-saving cures for Alzheimer’s, Parkinson’s and other diseases. The $3 billion proposition, backed by Democrat tycoon Robert Klein, created the California Institute for Regenerative Medicine (CIRM). The new state agency promptly hired former state senator and Democrat Party boss Art Torres, and at one point handed out more than 90 percent of its grants to institutions with representatives on its governing board.By 2020, CIRM had blown through the $3 billion but a ballpark figure for the number of cures and therapies was zero, perhaps the biggest bust in state history. Even so, CIRM is going back to the voters with the $5.5 billion California Stem Cell Research, Treatments, and Cures Initiative of 2020. To get the measure on the ballot, Klein’s Americans for Cures needed 950,000 signatures by April 18, and backers opted to push the envelope.Signature gatherers have been telling voters the measure was seeking only $1.5 billion, a blatant falsehood. As the deadline approached, Don Reed, Americans for Cures vice president of public policy, began pushing for mail-in signatures. “Your signatures might literally save CIRM, helping us put a $5.5 billion renewal bill on the ballot,” Reed wrote. “Its purpose is to fight chronic diseases, like COVID-19, the dread coronavirus—and so much more!!”Reed directed readers to a website with instructions to print out 16 pages, including an “address block to fill out, with yourself as the signature collector, and then four (just four!) signatures from people in your county. Your next door neighbors, perhaps.” This package was to be mailed in to Melissa King, executive director of Americans for Cures. She would take care of it from there.With their fraudulent signature harvesting, the stem cell scammers replicate the “ballot harvesting” of 2018. If things weren’t going the Democrat’s way, party activists simply dredged up fake ballots by any means necessary, and that was enough to push their candidate over the finish line. As it happens, the ballot and signature harvesting comes on comes on top of massive voter fraud already going on in California.After the 2016 election, California secretary of state Alex Padilla refused to participate in a federal probe of voter fraud. Democrats were already gearing up the “motor voter” plan, a boon for foreign nationals illegally present in the United States. When the illegals get driver’s licenses, the Department of Motor Vehicles automatically registers them to vote.By 2018, more than one million “new” voters were added to the rolls but Padilla won’t say how many actually voted. Democrats now want mail-in ballots sent to every registered voter across the country, and that would include millions of illegals.More than 22 million people are illegally present in the United States, according to a recent study by scholars at MIT and Yale. The previous default figure of 11 million is more like the number illegally present in California alone. Last year, when he challenged Trump’s public-charge rule, attorney general Xavier Becerra displayed a chart reading: “California is home to over 10 million immigrants,” code for false-documented illegals.State Democrats protect the illegals from deportation through sanctuary laws, even the many violent criminals in their ranks. Democrats also give illegals a host of public benefits, including health care, in-state college tuition and welfare, with zero compensation from the governments of the illegals’ own countries. In return for the benefits and protection, the illegals serve as the Democrats’ imported electoral college. This is what Democrats would like to see on a national scale, but there’s a problem.Democrats and their deep state allies failed to prevent Donald Trump from becoming president and the Russia and Ukraine hoaxes failed to remove him from office. Trump is meeting the challenge of the pandemic, and with November coming up fast, Democrats see viral voter fraud as their best shot to get Joe Biden, or whoever replaces him, into the White House.Nancy Pelosi, once Gavin Newsom’s aunt by marriage, says Republicans are “afraid of the voice of the people. And that’s one of the reasons they want to stand in the way of a more open democratic system at a time of a pandemic.” In reality, the pandemic makes a stronger case for beefing up voter ID rules.If people are being tested for coronavirus on a massive scale, it makes sense to verify that all voters are legitimate American citizens as the law requires. To be fair, congressional candidates with unbelievable back stories should also be required to provide full documentation. Munich terrorist’s grandson Ammar Campa-Najjar comes to mind, but others doubtless need scrutiny.Meanwhile, the signature count for the $5.5 billion California stem cell measure must be completed by June 15. The election takes place on November 3. As President Trump says, we’ll have to wait and see what happens.

CINCINNATI (Christian News Network) — The Sixth Circuit Court of Appeals has unanimously ruled that Kentucky Gov. Andy Beshear must allow churches to hold drive-in services, partly siding with a church where troopers had placed violation notices on every car in the parking lot on Easter Sunday. The church had allowed members to either sit inside or stay in their car, providing both options. Beshear denies that his stay-at-home order applies to drive-in services, but the appeals court disagreed and noted that members were issued notices regardless of whether they went inside or remained in their vehicles.The three judge panel, consisting of Judges Jeffrey Sutton, David McKeague and John Nalbandian, found that Beshear’s COVID ban on “mass gatherings” — including “faith-based” events — while sincere in its objective, does “not amount to the least restrictive way of regulating the churches.” Sutton and McKeague are Bush nominees and Nalbandian was nominated to the bench by President Trump.“The governor’s actions substantially burden the congregants’ sincerely held religious practices — and plainly so,” they wrote. “Orders prohibiting religious gatherings, enforced by police officers telling congregants they violated a criminal law and by officers taking down license plate numbers, amount to a significant burden on worship gatherings.”The judges stated that the order is discriminatory in that it seems to allow secular activities as long as social distancing is practiced, but does not grant the same allowances for church services.“On the same Easter Sunday that police officers informed congregants they were violating criminal laws by sitting in their cars in a parking lot, hundreds of cars were parked in grocery store parking lots less than a mile from the church,” the court noted. “The orders permit big-lot parking for secular purposes, just not for religious purposes. All in all, the governor did not narrowly tailor the order’s impact on religious exercise.”“Assuming all of the same precautions are taken, why is it safe to wait in a car for a liquor store to open but dangerous to wait in a car to hear morning prayers? Why can someone safely walk down a grocery store aisle but not a pew? And why can someone safely interact with a brave delivery woman but not with a stoic minister?” the panel also asked. “The Commonwealth has no good answers. While the law may take periodic naps during a pandemic, we will not let it sleep through one.”BACKGROUNDOn March 19, Gov. Beshear issued an order prohibiting “mass gatherings,” which “includ[ed] any event or convening that brings together groups of individuals, including, but not limited to, community, civic, public, leisure, faith-based, or sporting events; parades; concerts; festivals; conventions; fundraisers; and similar activities.” It did not state any size allowances.In early April, during his daily COVID-19 update, Beshear warned residents not to attend Easter gatherings, including church services, stating that their license plate numbers would be recorded and submitted to local health departments.“Any individual that’s going to participate in a mass gathering of any type that we know about this weekend, we are going to record license plates and provide it to local health departments,” he said. “Local health departments are going to come to your door with an order for you to be quarantined for 14 days.”“Understand that this is the only way that your decision doesn’t kill somebody else, that your decision doesn’t spread the coronavirus in your county and your community,” Beshear continued. “Your decision to go to a mass gathering doesn’t negate the sacrifice of every other house of worship — 99.99 percent that are choosing to do the right thing.”On Easter, two Kentucky state troopers did indeed record the license plate or VIN numbers of the approximately 50 worshipers at Maryville Baptist Church in Hillview, and members received letters advising that they were consequently required to quarantine. Some attendees went inside the church and some remained in their vehicles and listened to the service via outdoor speakers.“This vehicle’s presence at this location indicates that its occupants are present at a mass gathering prohibited by orders of the governor and the Cabinet for Health and Family Services,” the notices read in part.“Employees of the local health department will be contacting those associated with this vehicle with self-quarantine documents, including an agreement requiring this vehicle’s occupants and anyone in the household to self-quarantine for 14 days.”It also noted, “Please be advised that KRS 39A.990 makes it a Class A misdemeanor to violate an emergency order.”The church and its pastor, Jack Roberts, soon sued Beshear, stating that an injunction was necessary as they “remain targets of governor Beshear’s enforcement threats.”The legal challenge read in part:“Plaintiffs seek a TRO restraining enforcement against Plaintiffs of the various COVID-19 orders issued by Governor Beshear and other Commonwealth officials purporting to prohibit Plaintiffs, on pain of criminal sanctions and mandatory, household-wide quarantines … regardless of whether Plaintiffs meet or exceed the social distancing and hygiene guidelines pursuant to which the Commonwealth disparately and discriminatorily allows so-called ‘life-sustaining’ commercial and non-religious entities (e.g., beer, wine, and liquor stores, warehouse clubs, and supercenters) to accommodate large gatherings of persons without scrutiny or numerical limit.”DISTRICT COURT DENIALOn April 18, U.S. District Judge David Hale, nominated to the bench by then-President Barack Obama, ruled against Maryville Baptist Church, opining that Beshear’s order prohibiting “mass gatherings” does not discriminate against churches as it bans all mass gatherings.Unlike the appeals court, he did not find that Beshear’s order prohibited drive-in services, noting that churches have alternatives: drive-in, online, or telephone meetings, or watching online or listening on the radio.“[U]npersuasive is Plaintiffs’ contention that the orders violate their right to freely exercise their religion by discriminating against religious conduct. Again, the order temporarily prohibits ‘[a]ll mass gatherings,’ not merely religious gatherings,” Hale wrote. “Religious expression is not singled out. And further, contrary to Plaintiffs’ assertions, there are no identified exceptions to the prohibition on mass gatherings.”He additionally rejected the argument that it is unfair to allow supercenters or liquor stores to remain open while churches may not meet in person, finding that shopping is rather a “transitory experience” while church is more akin to a communal gathering at a concert or restaurant.“Plaintiffs seek to compare in-person attendance at church services with presence at a liquor store or ‘supercenter store[].’ The latter, however, is a singular and transitory experience:individuals enter the store at various times to purchase various items; they move around the store individually subject to strict social-distancing guidelines set out by state and federal health authorities — and they leave when they have achieved their purpose,” Hale wrote.“Plaintiffs’ desired church service, in contrast, is by design a communal experience, one for which a a large group of individuals come together at the same time in the same place for the same purpose.”ATTORNEY GENERAL SIDES WITH CHURCHThe church appealed, and Kentucky Attorney General Daniel Cameron submitted an amicus brief in support of Maryville Baptist Church and against his own governor.“These restrictions apply no matter how large the gathering might be, no matter where the people might get together, and regardless of whether they practice safe social-distancing and good hygiene. This is unconstitutional. But it does not have to be this way,” Cameron wrote.“By simply implementing the same social-distancing measures for religious gatherings as for liquor stores, retail chains, and offices, the governor could achieve the same state interest in a less-restrictive manner,” he opined.Cameron stated that churches are indeed being treated unfairly since secular activities are allowed, which makes the governor’s orders “quintessential discrimination against religion [and] requiring the state to meet the high burden of strict scrutiny.”“Even though these same orders broadly permit individuals to crowd into hardware stores and law offices, or newsrooms, liquor stores and grocery stores, they do not permit people to attend religious services at a church, mosque, synagogue, or other house of worship, even if they follow social-distancing guidelines. This is, without question, an unconstitutional targeting of religious activity,” he wrote.“Governor Beshear has publicly declared that attending worship service is not life-sustaining, while allowing liquor stores and retailers to continue operating. It is mind-boggling discrimination,” Cameron lamented. “Or as the court noted in a similar case, ‘if beer is ‘essential,’ so is Easter.”APPEALS COURT RULINGWhile the Sixth Circuit Court of Appeals said on Saturday that it did not feel “inclined” with going so far as placing an injunction on the ban as it pertains to in-person church services, it did suggest that Beshear could make allowances — like his order does with secular facilities — and simply create an occupancy limit if the size of the gathering is a concern.“Risks of contagion turn on social interaction in close quarters; the virus does not care why they are there. So long as that is the case, why do the orders permit people who practice social distancing and good hygiene in one place but not another?” the judges asked. “If the problem is numbers, and risks that grow with greater numbers, then there is a straightforward remedy: limit the number of people who can attend a service at one time.”“Sure, the church might use Zoom services or the like, as so many places of worship have decided to do over the last two months. But who is to say that every member of the congregation has access to the necessary technology to make that work? Or to say that every member of the congregation must see it as an adequate substitute for what it means when ‘two or three gather in my Name’ Matthew 18:20,” they noted.The panel pointed to the exceptions in one of Beshear’s orders and concluded that there should be wiggle room for religious practices as well.“The exception for ‘life-sustaining’ businesses allows law firms, laundromats, liquor stores, and gun shops to continue to operate so long as they follow social-distancing and other health-related precautions,” the judges outlined. “But the orders do not permit soul-sustaining group services of faith organizations, even if the groups adhere to all the public health guidelines required of essential services and even when they meet outdoors.”“How are in-person [office] meetings with social distancing any different from drive-in church services with social distancing?” the court asked. “Kentucky permits the meetings and bans the services, even though the open-air services would seem to present a lower health risk. The orders likewise permit parking in parking lots with no limit on the number of cars or the length of time they are there so long as they are not listening to a church service.”In its lawsuit against Beshear, attorneys for Maryville Baptist Church had noted that the troopers who issued the violation notices placed the warnings on every car in the parking lot — including one used by the local television station, which was there for a news report — regardless of whether the driver went inside the building or never left the safety of their vehicle.“Kentucky State Police did not enter the church building at Maryville Baptist Church, did not verify that any occupant of any car in the parking lot was actually inside the church building, and did not witness the social distancing and hygiene practices employed by Maryville Baptist Church inside its building on Easter Sunday,” the legal challenge stated.“The Kentucky State Police placed its notice on cars in the church’s parking lot solely because it was a parking lot associated with their targeted religious gathering.”The Church had hoped for an injunction both as it pertained to drive-in and in-person church services, but the appeals court stated that even though the ruling doesn’t grant everything the church wanted, “[a]llowance for drive-in services this Sunday mitigates some harm to the congregants and the church.”

We Hear You: House Actions Help Guide State Toward Safe Reopening
With Pennsylvania employers, workers and families continuing to struggle in the face of the COVID-19 pandemic, the House was back in session this week continuing our work to reopen businesses safely so people can return to work and support their families.
From the moment the governor abruptly announced his unconstitutional statewide business closure order in mid-March, the House has been fighting to bring openness, transparency and logic to the process.
We have taken action on bills to reopen construction (which is slated to open today), golf courses (also slated to reopen today, along with privately owned campgrounds, marinas and guided fishing trips), as well as automobile dealers, smaller retail stores, real estate, garden centers, pet groomers and more.
In fact, while we were debating legislation in the House to safely reopen the real estate industry, the Wolf administration issued new guidance to allow certain transactions to proceed.
Thank you for sharing your questions and concerns with us; we hear you, and it is making a difference.
Other bills advanced by the House this week:
• To help our communities and first responders, House Bill 2413 would invest up to $40 million in grants for fire and emergency medical services companies.
• To help save taxpayer dollars, House Bill 2418 would require a comprehensive review of all Commonwealth debt to identify opportunities to take advantage of refinancing at lower interest rates.
• House Bill 2392 would require the Independent Fiscal Office to include critical risk factors in its assessment of the Commonwealth’s fiscal condition to help lawmakers better plan and budget within our means.
• To address regulations, House Bill 2415 would require the Office of the Governor to notify legislative leaders in writing by electronic means when a specific statute or regulation is suspended, modified or waived under the authority of the emergency order.
• To ensure intergovernmental cooperation throughout the disaster and recovery period, House Bill 2419 would establish the COVID-19 inter-branch Cost and Recovery Task Force.
None of this could have been achieved without the people making their voices heard.
While this is great news, there are more sectors of PA’s economy that are ready to open safely and follow CDC guidelines. It is a matter of survival for more businesses to reopen now!

President Trump has declared the virus “the invisible enemy” and likened the response to World War II, saying he considers himself a “wartime president.” In the last Democratic presidential debate, former vice president Joe Biden proclaimed, “We’re at war with a virus.” Overseas, French President Emmanuel Macron says “we are at war” with COVID-19. British Prime Minister Boris Johnson, also referring to COVID-19 as a “deadly enemy,” noted that they must act like a “wartime government … to win the fight.” (source).

Spray disinfectant is a near impossible item to find on any shelf in the United States. Meats are gone. Grocery store shelves are empty. The third seal of Revelation 6, above, involves a spirit of economic upheaval.An 18th century commentary on this passage from Jonathan Gill summed up the severity of the phrase “a measure of wheat for a penny”:“…this phrase expresses such a scarcity, as that a man’s daily wages would be but just enough to buy himself bread, without any thing to eat with it; and when he would have nothing left for clothes, and other things, nor anything for his wife and children..” (source).The judgment of the third seal is a financial one, with families having to work a full day just to earn enough for bread for one person. Due to the shelter-in-place orders given from governments worldwide to curb the spread of COVID-19, the global economy has been ravaged. Hundreds of thousands of business have been forced to shutter and go into financial ruin since they are forbidden from operating. Restaurants, retailers and small business owners have been devastated from the government-mandated closings. Millions have lost their jobs and seen their savings evaporate. The stock markets have plummeted. Lines for food banks – devoted to sharing free food with those in need – span for miles at some locations. Basic food items have truly taken on the cost and investment of luxury goods.Interestingly, wine sales have seen a significant spike since the pandemic started as many people are stockpiling alcohol to “endure” the time being home for the most part with their families and loved ones. And the oil industry is set to recover from the initial financial damage of the pandemic as they are managing production to raise prices. As the Bible stated, the oil and wine are not being harmed by COVID-19.UNPRECEDENTED DEATH TOLLS – THE FOURTH SEAL

What has differentiated COVID-19 from any other pandemic of recent memory was that it has affected people of all socioeconomic strata all over the globe. For the first time in decades, Hollywood movies have been forced to stop production. Famous celebrities, accustomed to jet-setting around the globe, dining at their favorite establishments and bouncing between one of their many mansions, are now restricted to their homes lest they catch the plague. And for many of society’s elite, the answer has been to enter a “luxury bunker” – purchasing a deluxe underground shelter to protect them from the pandemic.In the end times, this will also take place. Elective Surgeries Restored
Last week, I joined with more than 50 of my House Republican colleagues in sending a letter calling on PA Health Secretary Dr. Rachel Levine to help save our struggling hospitals and other health care providers by lifting the COVID-19 prohibition on elective surgeries. As a direct result, the Department of Health has released new guidance that will allow hospitals and surgical centers to resume non-emergent surgeries and procedures, as long as the facilities remain prepared should they need to respond to COVID-19 cases. |
New York Mayor Bill de Blasio said Wednesday a funeral for an ultra-Orthodox rabbi that drew thousands of mourners in Brooklyn “was absolutely unacceptable,” and he warned that police will start issuing summonses or arrest violators at similar gatherings.
“It was a large gathering, again, tragically thousands of people. The amount of danger created by that kind of gathering is inestimable,” de Blasio said at a press conference. “People will die because of it, which goes against everyone’s values.”
Jewish organizations blasted the mayor’s comments.
Police didn’t issue any citations at Tuesday night’s funeral for Rabbi Chaim Mertz, but that will change, a police spokesperson said. De Blasio and NYPD Commissioner Dermot Shea said they are done warning people who violate social distancing guidelines. The rabbi died of Covid-19 at age 73, NBC New York reported.
Shea said “probably several thousand people” gathered on one block for the funeral, which was broken up by the NYPD.
“That event last night never should have happened, it better not happen again,” Shea warned. “You are putting my cops’ lives at risk and it’s unacceptable.”
On Tuesday night, de Blasio sent police to Brooklyn where a massive crowd of people could be seen in the streets attending the funeral. The mayor sent a series of tweets scolding the gatherers, saying he went to the scene himself to ensure the crowd dispersed.

The Democrat mayor of New York City has issued a dire warning eerily reminiscent of that which happened during the German Nazi regime under Adolph Hitler — round up Jewish people and arrest them. Stopping only short of announcing he’d toss them in concentration camps and gas them, he did say that this is all about “stopping this disease and saving lives.”You can’t make this stuff up. This comes on the heels of this anti-Constitutional tyrant who also threatened to shut down churches — PERMANENTLY — if they continued to hold worship services during the city’s lockdown.De Blasio obviously has a serious problem with the Constitution of the United States and civil liberties afforded people. The very first sentence in the very first amendment is abundantly clear:Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof…That de Blasio would make such a thoughtless statement and receive such little backlash speaks volumes of the direction the citizens of this country have taken. After endorsing the pro-gay Jen Hatmaker earlier this year, Max Lucado’s new-found role of propping up heretics and false teachers seems to have hit overdrive. In January, Lucado joined Hatmaker on her podcast and gave her glowing accolades telling her that she made listening to her “easy and delightful, and yet profound at the same time.”Lucado, who I described as “fairly orthodox though not without problems,” clearly compromised the gospel with his endorsement of Hatmaker, lending credibility to her as a minister of the gospel when clearly her “gospel” is false.Now, it’s safe to say that Lucado himself should be avoided at all costs since he does not have the discernment, wisdom, and heart to separate himself from false teachers who are harming the Kingdom of God.In a recent show, Lucado endorsed Steven Furtick — a false teacher who twists the Scriptures, preaches Word of Faith heresy, and just recently embraced the heresy of modalism which denies the orthodox view of the Trinity — and promoted Furtick as though he is a man of God with godly things to say about Christians getting through the coronavirus.Steven Furtick is perhaps one of the most obvious examples of a hipster false teacher. Not only is he the protege of modalist heretic T.D. Jakes, Furtick runs his business, oh, I mean "church" like an entertainment center, ticking ears while sound doctrine is slain in the streets fulfilling the word of God which says "the time will come when they will not endure sound doctrine". But Furtick makes money and he is popular which is probably the main reason why Max Lucado is promoting him. It certainly doesn't have anything to do with a love of the truth.

At the behest of the World Health Organization (WHO) executive director Michael Ryan, Oregon is slated to remove children from homes and place them in “substitute care” if parents are deemed “unable to support them.”Ryan, who was criticized for stating that governments need to go door-to-door looking for people infected with coronavirus and if found, “Now we need to go and look in families to find those people who may be sick, and remove them and isolate them.”Oregon seems to be complying with these orders:State and local “child welfare” departments have a history of mishandling child welfare cases and over-indulge in their power to forcibly separate children from their parents — and this will be no different. According to a document released and authorized by Lacey Andresen, the Deputy Director of Oregon’s Child Welfare & Practice Program, effective April 22, “a child will enter substitute care because their caregiver is infected with COVID-19.”What constitutes “unable to support them” isn’t exactly spelled out, but if history repeats itself, this is nothing more than a power grab to remove children from their parents and place them in foster care systems overseen by the state — and once children are handed over to the state, it is an uphill battle to get them back.

In today’s Re-Open California #EndThe Lockdown protest in Sacramento, embattled Californians will circle the state Capitol in cars, trucks and on motorcycles. They might have assembled on the spacious grounds of the Capitol, as they did in January to protest Assembly Bill 5, which threatens Californians’ right to earn a living. By April, the California Highway Patrol was refusing to issue permits for events at any state properties, including the Capitol. As it happens, free speech and assembly are not the only constitutional rights Gov. Newsom is out to crush.As it emerged Thursday, the governor intends to close all state beaches and parks. Gov. Newsom does not want thousands of Californians flocking to the beach, as they did the past weekend during a heat wave. So the freedom of movement also disturbs the San Francisco Democrat.On Wednesday, Newsom told reporters “we believe we are weeks, not months, away from making meaningful modifications to that indicator,” a reference to his shelter-in-place order. Gov. Newsom did not explain what “modifications” he had in mind or when, exactly, he would make them. If Californians believe Newsom would keep the lockdown in place until, say, November 3 or beyond, it would be hard to blame them.Solitary surfers have been arrested and Newsom’s mayor allies have set up a Stasi-style system that rewards informers. With the number of unemployed Californians approaching three million, Newsom signs a $1 billion deal with Chinese company BYD for 200 million masks a month, in a state of 40 million people.While he boosts employment in China, Gov. Newsom maintains a lockdown that will doubtless shutter small businesses for good and deprive more Californians of their ability to earn a living. That is what state Democrats were doing before the coronavirus left Wuhan, China, and landed in California.Last year, Gov. Newsom signed California Assembly Bill 5, by San Diego Democrat Lorena Gonzalez, a virtual declaration of war against independent contractors of all kinds. AB-5 is the first measure openly to oppose the professions Californians choose for themselves, the first measure to deny Californians their rights of free association, and the first measure to limit workers’ ability to earn a living.The measure limits freelance writers, photographers and videographers to 35 submissions per publication, per year. AB-5 has also taken work from independent contractors in many fields including health care. The repressive measure is being challenged in the courts but legislators have declined to suspend it. With a pandemic damaging the state, 151 of California’s leading economists and political scientists, including Nobel laureate Vernon Smith of Chapman University, John Taylor of Stanford, Lee Ohanian of UCLA, and David Teece of UC Berkeley, sent an open letter to Gov. Newsom.With employers not hiring, the 151 argued, gig workers could shoulder the many tasks needed to flatten out the effects of the temporary emergency. And as the signatories saw it, “AB-5 is doing substantial, and avoidable, harm to the very people who now have the fewest resources and the worst alternatives available to them,” so the measure should be suspended.Such a sensible move would incur no costs and help countless workers get back on their feet. Even so, at this writing, Gov. Newsom has declined to suspend or “modify” the measure. So California workers could be forgiven for believing that, even as the coronavirus declines, Newsom will keep the lockdown in place. As Californians have noticed, the Democrats’ dapper Il Duce likes to dish but not take.Katy Grimes of the California Globe cites Newsom’s “refusal to stand in front of media every day and answer the hard questions the way the President does.” Newsom conducts his briefings remotely and journalists must call in with questions. As Grimes explains, “not one reporter has asked him why healthy people are being quarantined. Not one reporter has asked the governor why he is depriving citizens of constitutional and civil rights. Not one has questioned the governor about the misuse of police to enforce depriving people of their civil rights.”Chief among them is the right to protest, but now the governor has put the Capitol and all state property off limits. The Democrat Duce seems unaware of California’s long tradition of protest. As they take it to the streets, the state Capitol, and the beaches, the people of California will be watching carefully how the staatspolizei respond. The governor, for his part, has already made it clear what he’s about.Back in March, when he announced the lockdown, Newsom thanked House Speaker Nancy Pelosi and gushed, “we are so blessed to have her leadership in California.” So behind the scenes Nancy is calling the shots, even as her one-time nephew by marriage is touted as a presidential contender in 2024.In the meantime, Gavin Newsom previews what life would be like under the administration of just about any Democrat. As President Trump says, we’ll have to wait and see what happens.

As Christians worldwide celebrated their most significant holiday, their most recognizable figure delivered a distinctly secular message.On Easter Sunday, the Vatican released a letter Pope Francis wrote to Catholic organizations in South America. Francis wrote that the coronavirus pandemic “might be a good time to consider a universal basic wage” that would enable the poor to enjoy “the benefits of globalism.”Such a measure, Francis wrote, “would ensure and concretely achieve the ideal, at once so human and so Christian, of no worker without rights.”Toward the end of his letter, Francis hoped the pandemic would generate “a humanist and ecological conversion that puts an end to the idolatry of money, and places human life and dignity at the center.”Nowhere in his letter did Francis mention Jesus Christ.The letter conclusively proves that Francis is transforming the Catholic Church into another non-governmental organization. In the process, he is destroying the church's identity and credibility.Francis’ activism reflects and culminates the Vatican’s embrace of humanist utopianism, which Front Page Magazine briefly addressed last year in “They Died For 'Dialogue’?” That article traced the Holy See’s policy of appeasing Islam and China to the radical globalism adopted at the Second Vatican Council, which met from 1962 to 1965.A pastoral document written on politics and economics during the council stated that “there must be made available to all men everything necessary for leading a life truly human, such as food, clothing, and shelter. ... Hence, the social order and its development must invariably work to the benefit of the human person.”In 1967, Pope Paul VI called for international agencies to create “a full-bodied humanism,” he wrote, by managing the world's economic and political development:Such international collaboration among the nations of the world certainly calls for institutions that will promote, coordinate and direct it, until a new juridical order is firmly established and fully ratified. We give willing and wholehearted support to those public organizations that have already joined in promoting the development of nations, and We ardently hope that they will enjoy ever growing authority.In 2009, Pope Benedict XVI took that concept to its logical conclusion by advocating that the United Nations direct both international and domestic economic policies:In the face of the unrelenting growth of global interdependence, there is a strongly felt need...for a reform of the United Nations...and, likewise, of economic institutions and international finance, so that the concept of the family of nations can acquire real teeth....To manage the global economy...to bring about integral and timely disarmament, food security and peace; to guarantee the protection of the environment and to regulate migration: for all this, there is urgent need of a true world political authority...This authority, Benedict wrote, must "seek to establish the common good" and "have the authority to ensure compliance with its decisions from all parties, and also with the coordinated measures adopted in various international forums."The ultimate purpose, Benedict wrote, would be to design a "directed" global economy that would "open up the unprecedented possibility of large-scale redistribution of wealth on a world-wide scale" - - including "a worldwide redistribution of energy resources, so that countries lacking those resources can have access to them."In promoting such an authority, Benedict subtly redefined the Catholic Church's primary role from proclaiming the Gospel to ensuring economic benefits for all -- or, at least, redefining the Gospel in materialist terms. Benedict even presumed that global economic management through a “true world political authority" can achieve spiritual harmony.When animated by charity, commitment to the common good ... has a place within the testimony of divine charity that paves the way for eternity through temporal action. Man's earthly activity, when inspired and sustained by charity, contributes to the building of the universal city of God, which is the goal of the history of the human family.Like his predecessors, Francis believes globalism is pivotal. In an August interview with the Italian newspaper La Stampa, Francis criticized nationalist movements threatening the European Union:Europe cannot and must not break apart. It is a historical, cultural, as well as geographical, unity. Never forget that ‘the whole is greater than the parts.’ Globalization, unity, should not be conceived as a sphere but as a polyhedron. Each people retains its identity in unity with others.Francis' bishops promote the new prime directive. “They Died For ‘Dialogue’?” mentions the praise Bishop Marcelo Sanchez Sorondo, the chancellor of the Pontifical Council for Sciences and Social Sciences, gave China in February 2018:Right now, those who are implementing the Church's social doctrine the best are the Chinese.They search for the common good and subordinate everything to the general welfare.Sorondo particularly praised China's implementation of "Laudato Si," Francis' environmental encyclical, for "defending the dignity of the person" and "assuming a moral leadership that others have left," a criticism of the United States' withdrawal from the Paris Agreement on carbon-dioxide emissions.Sorondo issued his praise despite the fact that China ranks among the world's worst air polluters, performs between 10 million and 23 million abortions a year -- many of them forced by the government -- and persecutes Christians who worship outside of state-approved churches.In June 2018, Cardinal Pietro Parolin became the first official from the Holy See to attend the Bilderberg Meetings, where international figures from business, finance, government, communications and academia gathered to discuss such topics as political populism, free trade and economic inequality. Eighteen months earlier, Parolin had addressed the World Economic Forum in Davos, Switzerland.Parolin -- the Vatican's second-most powerful figure as its secretary of state -- received an invitation from the Bilderberg organizers, who insisted upon his presence.Nearly three months later, Chicago Cardinal Blase Cupich vividly illustrated the papacy's priorities. Immediately after Archbishop Carlo Maria Vigano alleged that Francis protected and promoted sexual predators among the bishops, Cupich performed his best imitation of Marie Antoinette."The Pope has a bigger agenda," Cupich told Chicago's WMAQ-TV. "He's got to get on with other things: talking about the environment, protecting migrants and carrying on the work of the Church. We're not going to go down a rabbit hole on this."Cupich repeated that theme the next day at Mundelein Seminary in suburban Chicago: "We have a bigger agenda than to be distracted by all of this," Cupich told the seminarians, one of whom spoke anonymously to the Chicago Sun-Times about the archbishop's address. The Sun-Times published the story after receiving confirmation from other sources, including several seminarians.If Catholic prelates are willing to disregard the victimization of the innocent, nobody should expect them to uphold the church’s historic opposition to abortion and contraception.In February, one month before California‘s primary, San Diego Bishop Robert McElroy issued voting guidelines for Catholics in his diocese. But McElroy did more than reiterate support for Francis’ positions on environmentalism and immigration. He essentially stated that those positions held greater significance than the church’s stance against abortion and contraception.While conceding that abortion was “intrinsically evil,” McElroy criticized the idea that “candidates who seek laws opposing intrinsically evil actions automatically have a primary claim to political support in the Catholic conscience.”“The problem with this approach is that while the criterion of intrinsic evil identifies specific human acts that can never be justified, this criterion is not a measure of the relative gravity of the evil in particular human or political actions,” McElroy wrote. “Telling a lie is intrinsically evil, while escalating a nuclear arms race is not. But it is wrongheaded to propose that telling a lie to constituents should count more in the calculus of faithful voting than a candidate’s plans to initiate a destabilizing nuclear weapons program."Similarly, contraception is intrinsically evil in Catholic moral theology, while actions which destroy the environment generally are not. But it is a far greater moral evil for our country to abandon the Paris Climate Accord than to provide contraceptives in federal health centers. (emphasis added)Perhaps no better example of the Vatican’s embrace of humanist globalism exists than the presence of economist Jeffrey Sachs as a papal advisor. Sachs, who drafted the UN’s Sustainable Development Goals, supports abortion as an integral part of population control. Nevertheless, he participates frequently in Vatican conferences on sustainability.So why would Francis have Sachs as an advisor? Consider these comments the economist made to the National Catholic Register after one such conference in February:Asked whether by the Church’s teaching on human dignity he meant respect for life from conception to natural death, Sachs replied: ‘I mean everybody’s economic needs should be met, that people should have the dignity of work, that the poor should be helped, that this is about the core ideas of human well-being.’Asked if by helping the poor he meant wealth creation, he said: ‘Jesus said, “He who feeds the least among me, feeds me.” He was talking about helping the poor. When Aristotle talks about politics or the common good, he’s talking about a society in which people afforded dignity.’‘We know why our current system leads to massive inequalities, leaving billions of people behind,’ he said, ‘and so this is about public policy, about individual ethics, social organization. It’s about our attitudes towards others.’When questioned by Pontius Pilate, Jesus said that his kingdom was not of this world. Yet as Sachs demonstrates, Catholicism is trying to gain the whole world by being like the world. By doing so, the church is losing its own soul.

Raymond Ibrahim is a Shillman Fellow at the David Horowitz Freedom Center.Last Friday, April 24, marked the “Great Crime,” that is, the genocide of Christians—primarily Armenians Assyrians and Greeks—that took place under the Islamic Ottoman Empire, throughout World War I. Then, in an attempt to wipe out as many Christians as possible, the Turks massacred approximately 1.5 million Armenians, 300,000 Assyrians, and 750,000 Greeks.Most objective American historians who have studied the question unequivocally agree that it was a deliberate, calculated genocide:More than one million Armenians perished as the result of execution, starvation, disease, the harsh environment, and physical abuse. A people who lived in eastern Turkey for nearly 3,000 years [more than double the amount of time the invading Islamic Turks had occupied Anatolia, now known as “Turkey”] lost its homeland and was profoundly decimated in the first large-scale genocide of the twentieth century. At the beginning of 1915 there were some two million Armenians within Turkey; today there are fewer than 60,000…. Despite the vast amount of evidence that points to the historical reality of the Armenian Genocide, eyewitness accounts, official archives, photographic evidence, the reports of diplomats, and the testimony of survivors, denial of the Armenian Genocide by successive regimes in Turkey has gone on from 1915 to the present.Similarly, in 1920, U.S. Senate Resolution 359 heard testimony that included evidence of “[m]utilation, violation, torture, and death [which] have left their haunting memories in a hundred beautiful Armenian valleys, and the traveler in that region is seldom free from the evidence of this most colossal crime of all the ages.”In her memoir, Ravished Armenia, Aurora Mardiganian described being raped and thrown into a harem (consistent with Islam’s rules of war). Unlike thousands of other Armenian girls who were discarded after being defiled, she managed to escape. In the city of Malatia, she saw 16 Christian girls crucified: “Each girl had been nailed alive upon her cross,” she wrote, “spikes through her feet and hands, only their hair blown by the wind, covered their bodies.” Such scenes were portrayed in the 1919 documentary film Auction of Souls, some of which is based on Mardiganian’s memoirs.Whereas the genocide is largely acknowledged in the West, one of its primary if not fundamental causes is habitually overlooked: religion. The genocide is usually articulated through a singularly secular paradigm, one that factors only things that are intelligible from a secular, Western point of view—such as identity and gender politics, nationalism, and territorial disputes. Such an approach does little more than project modern Western perspectives onto vastly different civilizations and eras.War, of course, is another factor that clouds the true face of the genocide. Because these atrocities mostly occurred during World War I, so the argument goes, they are ultimately a reflection of just that—war, in all its chaos and destruction, and nothing more. But as Winston Churchill, who described the massacres as an “administrative holocaust,” correctly observed, “The opportunity [WWI] presented itself for clearing Turkish soil of a Christian race.” Even Adolf Hitler, ominously presaging his own plans, had pointed out that “Turkey is taking advantage of the war in order to thoroughly liquidate its internal foes, i.e., the indigenous Christians, without being thereby disturbed by foreign intervention.”It’s worth noting that little has changed; in the context of war in Iraq, Syria, and Libya, the first to be targeted for genocide have been Christians and other minorities.But even the most cited factor of the Armenian Genocide, “ethnic identity conflict,” while legitimate, must be understood in light of the fact that, historically, religion accounted more for a person’s identity than language or heritage. This is daily demonstrated throughout the Islamic world today, where Muslim governments and Muslim mobs persecute Christian minorities who share the same race, ethnicity, language, and culture; minorities who are indistinguishable from the majority—except, of course, for being non-Muslims, or “infidels.”As one Armenian studies professor asks, “If it [the Armenian Genocide] was a feud between Turks and Armenians, what explains the genocide carried out by Turkey against the Christian Assyrians at the same time?” The same can be said about the Greeks. From a Turkish perspective, the primary thing Armenians, Assyrians, and Greeks had in common was that they were all Christian “infidels.”According to a 2017 book, Year of the Sword: The Assyrian Christian Genocide, the “policy of ethnic cleansing was stirred up by pan-Islamism and religious fanaticism. Christians were considered infidels (kafir). The call to Jihad, decreed on 29 November 1914 and instigated and orchestrated for political ends, was part of the plan” to “combine and sweep over the lands of Christians and to exterminate them.” As with Armenians and Greeks, eyewitness accounts tell of the sadistic eye-gouging of Assyrians and the gang rape of their children on church altars. According to key documents, all this was part of “an Ottoman plan to exterminate Turkey’s Christians.”Today, from Indonesia in the east to Morocco in the west, from Central Asia in the north, to sub-Sahara Africa—that is, throughout the entire Islamic world—Muslims are, to varying degrees, persecuting, killing, raping, enslaving, torturing and dislocating Christians; where formal Islamic groups such as the Islamic State (ISIS), Al Shabaab, Boko Haram, etc., hold sway, Christians and other “infidels” are literally experiencing a genocide. (See Crucified Again: Exposing Islam’s New War on Christians — or my monthly “Muslim Persecution of Christians” report — for a comprehensive and ongoing account of the “great crime” of our times.)To understand how the historic genocide of Armenians, Assyrians, and Greeks is representative of the modern day plight of Christians under Islam, one need only read the following words written in 1918 by President Theodore Roosevelt; however, read “Armenian” as “Christian” and “Turkish” as “Islamic,” as supplied in brackets:the Armenian [Christian] massacre was the greatest crime of the war, and the failure to act against Turkey [the Islamic world] is to condone it… the failure to deal radically with the Turkish [Islamic] horror means that all talk of guaranteeing the future peace of the world is mischievous nonsense.Similarly, if we “fail to deal radically” with the “horror” currently being visited upon millions of Christians around the Islamic world, we “condone it” and had better cease talking “mischievous nonsense” of a utopian world of peace and tolerance.Put differently, silence is always the ally of those who would liquidate the “other.” In 1915, Adolf Hitler rationalized his genocidal plans, which he implemented some three decades later, when he rhetorically asked: “Who, after all, speaks today of the annihilation of the Armenians?”And who among today’s Western politicians speaks—let alone does anything—about the ongoing annihilation of Christians by Muslims?

FRANKFORT, Ky. (Christian News Network) — Kentucky Attorney General Daniel Cameron has filed an amicus brief in support of a local church and against his own governor, stating that Andy Beshear’s blanket halt on in-person church services, without taking into account the size of the gathering or the distancing between attendees, is “unconstitutional.”“These restrictions apply no matter how large the gathering might be, no matter where the people might get together, and regardless of whether they practice safe social-distancing and good hygiene. This is unconstitutional. But it does not have to be this way,” Cameron wrote on Wednesday in support of an appeal in the case of Maryville Baptist Church v. Beshear.“By simply implementing the same social-distancing measures for religious gatherings as for liquor stores, retail chains, and offices, the governor could achieve the same state interest in a less-restrictive manner,” he opined.Cameron gave examples of considerations or criteria that Beshear could put forward instead of a general ban.“[T]he order could permit small gatherings, or gatherings based upon the size of the space in which people meet,” he said. “Could a congregation of ten individuals, for example, meet for worship in a large auditorium?”BACKGROUNDOn March 19, Gov. Beshear issued an order prohibiting “mass gatherings,” which “includ[ed] any event or convening that brings together groups of individuals, including, but not limited to, community, civic, public, leisure, faith-based, or sporting events; parades; concerts; festivals; conventions; fundraisers; and similar activities.” It did not state any size allowances.Earlier this month, during his daily COVID-19 update, Beshear warned residents not to attend in-person Easter gatherings, including church services, stating that their license plate numbers would be recorded and submitted to local health departments.“Any individual that’s going to participate in a mass gathering of any type that we know about this weekend, we are going to record license plates and provide it to local health departments,” he said. “Local health departments are going to come to your door with an order for you to be quarantined for 14 days.”“Understand that this is the only way that your decision doesn’t kill somebody else, that your decision doesn’t spread the coronavirus in your county and your community,” Beshear continued. “Your decision to go to a mass gathering doesn’t negate the sacrifice of every other house of worship — 99.99 percent that are choosing to do the right thing.”On Easter, two Kentucky state troopers did indeed record the license plate or VIN numbers of the approximately 50 indoor worshipers at Marysville Baptist Church in Hillview, and members received letters advising that they were consequently required to quarantine.“This vehicle’s presence at this location indicates that its occupants are present at a mass gathering prohibited by orders of the governor and the Cabinet for Health and Family Services,” the notices read in part.“Employees of the local health department will be contacting those associated with this vehicle with self-quarantine documents, including an agreement requiring this vehicle’s occupants and anyone in the household to self-quarantine for 14 days.”It also noted, “Please be advised that KRS 39A.990 makes it a Class A misdemeanor to violate an emergency order.”The church and its pastor, Jack Roberts, soon sued Beshear, stating that an injunction was necessary as they “remain targets of governor Beshear’s enforcement threats.”The legal challenge read in part:“Plaintiffs seek a TRO restraining enforcement against Plaintiffs of the various COVID-19 orders issued by Governor Beshear and other Commonwealth officials purporting to prohibit Plaintiffs, on pain of criminal sanctions and mandatory, household-wide quarantines … regardless of whether Plaintiffs meet or exceed the social distancing and hygiene guidelines pursuant to which the Commonwealth disparately and discriminatorily allows so-called ‘life-sustaining’ commercial and non-religious entities (e.g., beer, wine, and liquor stores, warehouse clubs, and supercenters) to accommodate large gatherings of persons without scrutiny or numerical limit.”INJUNCTIVE RELIEF DENIEDHaleOn April 18, U.S. District Judge David Hale, nominated to the bench by then-President Barack Obama, ruled against Maryville Baptist Church, opining that Beshear’s order prohibiting in-person “mass gatherings” does not discriminate against churches as it bans all mass gatherings.He also noted that churches have alternatives: drive-in, online, or telephone meetings, or watching online or listening on the radio.“[U]npersuasive is Plaintiffs’ contention that the orders violate their right to freely exercise their religion by discriminating against religious conduct. Again, the order temporarily prohibits ‘[a]ll mass gatherings,’ not merely religious gatherings,” Hale wrote. “Religious expression is not singled out. And further, contrary to Plaintiffs’ assertions, there are no identified exceptions to the prohibition on mass gatherings.”He additionally rejected the argument that it is unfair to allow supercenters or liquor stores to remain open while churches may not meet in person, finding that shopping is rather a “transitory experience” while church is more akin to a communal gathering at a concert or restaurant.“Plaintiffs seek to compare in-person attendance at church services with presence at a liquor store or ‘supercenter store[].’ The latter, however, is a singular and transitory experience:individuals enter the store at various times to purchase various items; they move around the store individually subject to strict social-distancing guidelines set out by state and federal health authorities — and they leave when they have achieved their purpose,” Hale wrote.“Plaintiffs’ desired church service, in contrast, is by design a communal experience, one for which a a large group of individuals come together at the same time in the same place for the same purpose.”CAMERON INTERVENESThe church appealed, and Attorney General Cameron argued in his amicus brief in support of Marysville Baptist Church on Wednesday that Hale got it wrong.“Simply put, permitting worshipers to attend a service where everyone typically remains in the same spot throughout (all the while social distancing) will logically place fewer Kentuckians within six feet of one another than shopping at a grocery store, hardware store, or other retail business where they will continuously pass one another, stand in line together, or bump into one another as they turn a corner,” he contended.“And that is not to mention that in such retail establishments shoppers will pick up and put back goods, push the same shopping carts, and touch the same credit card machines.”Cameron opined that churches are indeed being treated unfairly since secular activities are allowed, which makes the governor’s orders “quintessential discrimination against religion [and] requiring the state to meet the high burden of strict scrutiny.”“Even though these same orders broadly permit individuals to crowd into hardware stores and law offices, or newsrooms, liquor stores and grocery stores, they do not permit people to attend religious services at a church, mosque, synagogue, or other house of worship, even if they follow social-distancing guidelines. This is, without question, an unconstitutional targeting of religious activity,” he wrote.“Governor Beshear has publicly declared that attending worship service is not life-sustaining, while allowing liquor stores and retailers to continue operating. It is mind-boggling discrimination,” Cameron lamented. “Or as the court noted in a similar case, ‘if beer is ‘essential,’ so is Easter.”He said that while none doubt that the government has an interest in preventing the spread of COVID-19, “Governor Beshear has offered no explanation as to why it is necessary to prohibit religious activities that pose exactly the same risk as similar, non-religious activities.”Cameron also held a press conference about the issue on Wednesday (view it below), and warned in a press release, “Governor Beshear should immediately rescind the executive orders targeting faith-based gatherings, and, if he doesn’t, then we will be forced to file a lawsuit and allow a judge to determine whether his order, as it pertains to religious groups, is constitutional.”Beshear defended his actions, stating, according to WYMT, “Folks, I’m not trying to set rules that are difficult, and I’m not trying to set rules that are controversial. I’m just trying to set rules that save lives.”
