Independent Member of Parliament Dr. Heinrich Fiechtner was forcibly removed from Stuttgart Germany’s state parliament by police on Wednesday after he slammed the left-wing parties running Germany. Dr. Fiechtner accused them of “having blood on their hands” for flooding the country with migrants who screamed “Allahu Akbar” as they took part in the massive riots in Stuttgart last week.

Fiechtner’s powerful speech has been widely condemned by left-wing politicians and media as “hate speech“. “Hate speech” is the Marxist version of Islamic blasphemy laws. State Parliamentary President, Turkish Muslim Muhterem Aras from the communist Greens Party, went so far as to expel the politician during the debate over the Stuttgart riots, even calling the police to remove him. He was also suspended for five sessions of parliament.

Dr. Fiechtner slammed the communist policies of the established leaders who allowed Germany to be flooded with dangerous migrants waging war on their host country. This past weekend’s horrific riots in Stuttgart, which resulted in massive damage to businesses and left 19 police officers injured, is one example of the violence.

Fiechtner had his right to speak removed by President of the State parliament after Fiechter condemned her political party (Greens) and the other left-wing party leaders, for their refusal to admit or deal with the migrant nature of the rioters in Stuttgart. He further accused them of wanting to overrun Germany with foreigners and communists:

All of you, from the green, red [SPD], black [Merkel’s CDU] and magenta [Leftists] know it. You have skeletons in your closet. It was you who wanted to see our German population overrun by foreigns. It was you who in Thuringia voted, a communist, into office. There’s blood on your hands!

years old, I'm still learning every day. This past weekend, my newest insight was that the term 
‘party scene’seems to be a new geographical term for the Arab region and the Maghreb.

Another new insight came while watching what seems to be the newest Corona prevention measures in 
Stuttgart:

Going out and celebrating wearing a balaclava. It also seems to be necessary to equip yourself 
with an iron bar. That’s probably necessary to maintain a distance of one and a half meters. 
Mobs of left-wing extremist and mobs dominated by foreigners are well known in our Republic, 
and not just since yesterday. During the Stuttgart 21 protests and more recently at the G20-17 
summit in Hamburg, we witnessed the extent of uncontrolled riots. 

Even in this case, politicians are watching with relish and shed their crocodile tears. 
Just imagine if the riots had happened in East Germany and right-wing extremists had shown up. 
The next day, Federal President Steinmüller would have been at the scene, bringing flowers, 
new laws would be passed, standoff speeches would have been made, and the culprits would already 
have been identified. In this case, there’s persistent silence about the details and background 
information. Not even a clearly audible ‘Allahu Akhbar’ is recognized as a clear statement. 
All of you, from the green, red [SPD], black [CDU] and magenta [Leftists] know it. You 
have skeletons in your closet. It was you who wanted to see our German population overrun 
by foreigners. It was you who in Thuringia voted Ramelow, a communist, into office. There’s

What have we come to here, ladies and gentlemen? I strongly reject this expulsion. Regardless 
of one’s opinion of Dr. Fiechtner, there is absolutely no legal basis for this expulsion. 
I would like to state that as protest. Of course. Now on to today’s topic.

Hello dear friends of truth. And freedom. Dear friends of freedom. That’s what this is about 
here in this chamber.

Once again, the parliamentary president has overstepped her authority. Once again, she abused 
her office in a totalitarian, even fascist manner, in order to limit free speech and prevent 
me from executing my mandate. She went so far as to expel me, once again, from the 
parliamentary sessions.

Of course, since I refused to give free rein to this lawlessness or to acquiesce to it. 
I stood firm. As was to be expected, this woman, whom I now must describe as a political 
criminal, because she acts in such a manner that suitable for a totalitarian system, but 
certainly not in a state under the Rule of Law. A state that values freedom, the rule of law 
and integrity.

The press is fully engaged in pushing their PR, saying that the parliamentary member 
Dr. Fiechtner provoked or induced his own expulsion through provocation. This is by no 
means the case!

I gave two speeches. For both, Ms. Aras issued me reprimands for being out of order. In my 
last speech, I stated that these parties have blood on their hands. That’s right! The excessive 
violence in Stuttgart is a result of the absolutely twisted and failed policy of the 
established parties, starting with the Green Party, then the SPD, but also the CDU and FDP. 
These parties do have blood on their hands. That’s exactly what I just told them. For that reason, 
this president believes she has the authority to issue me a reprimand and to deprive me of the 
right to speak. In response, I said they should all go outside, to the nearby Königsstraße and 
pick up the shards of their policy.

I also told them to take the parliamentary president with them. That was her reason for banning 
me from this chamber. Are you serious?! Has this woman lost her marbles? Apparently, I have been 
banned for the next five parliamentary sessions. The procedure was the same as last time. I 
refused to leave, so they called the police. 

However, this time I was determined not to leave voluntarily, no. I told that to the police 
officer, whom I greeted in a friendly manner like the last time. I told him no, I wouldn’t 
be leaving voluntarily. They would have to do what they have to do, and physically remove me 
if they intended to follow these orders. I advise them of the possibility of remonstration, to 
refuse or accept orders that are obviously unlawful. The officers who were present thought 
everything was correct.

So I had to ask them if they weren’t ashamed of themselves for forcefully removing, carrying 
an elected official from the parliamentary chamber. They said they weren’t ashamed. So that 
does leave an unpleasant aftertaste in respect to how some police officers behave. Especially 
since this debate dealt with the violence that police officers must endure from violent 
criminals, from imported violent criminals and leftist violent criminals, in which they suffer 
injuries. Not to mention that I just went to bat for them, but it remains a very ambivalent, 
dubious topic.

It just proves that the police are always the tool of those who rule, and if those who rule 
are bad, it often means the work of the police isn’t what it should be. I’m shocked, and need 
to express how extremely emotionally churned-up inside I am. I have to say, I’m even close to 
tears, in light of this kind of offense.

Naturally, I must consider subsequent actions. Submitting an objection against this decision 
goes without saying. That is the prerequisite for proceeding with any further action at all. 
An additional step would be a lawsuit submitted to the German Supreme Court, which I think, 
in this case, must happen. If boundaries aren’t drawn now, then our parliamentary system 
is definitely lost.

So, my dear friends, continue to hold aloft the flag in this battle for freedom. Our country 
is in serious danger. Our country is under attack. If we want to preserve our country, we 
must stay united, rise up and develop a thick skin.

BLACK LIVES MATTER: NOT JUST COMMUNIST, BUT VICIOUSLY ANTI-SEMITIC TOO

By the time violent rioters tore through the heavily Jewish neighborhood of Fairfax, Los Angeles on the night of Saturday May 30, 2020, it was too late. The vicious antisemitic, anti-Israel language of the M4BL and Black Lives Matter’s demands that included accusations against Israel of “apartheid” and “genocide” had been brushed aside. Black Lives Matter (BLM) delegations had traveled to the Middle East to endorse Palestinian terrorists in Gaza, Judea, and Samaria and pose for photo ops with the Palestinian flag. Statements from delegation leaders spoke of “occupation, ethnic cleansing and brutality” that Israel supposedly has perpetrated against the region’s Arab-Muslim population.

Even when city after city across America went up in flames after the May 25, 2020 killing of African-American George Floyd in Minneapolis by a white police officer, with BLM ‘protesters’ assaulting private businesses, their owners, and law enforcement officers alike, smashing store fronts, setting fires, and destroying property, some among America’s Jewish leadership could hardly get their statements of support out fast enough. Jewish American organizations, the Reform Movement, rabbinical leadership figures, progressive and Zionist activists, even the Hasidic Community of Crown Heights, Brooklyn in New York City all practically fell over one another in their haste to endorse the BLM movement.

The Jewish Federation of Santa Barbara was no different. On June 13, 2020, the group – including, among others, the Jewish Federation of Greater Santa Barbara, ADL Santa Barbara Tri-Counties, Santa Barbara Congregation of B’nai B’rith and Santa Barbara Hillel – issued a statement to condemn “racism” and “institutional biases.” The Focus Project, whose online website is remarkably empty, disseminated a set of talking points on June 16, 2020 that appear to date from September 2019. An increasingly popular trope is included among them that distorts the ancient Jewish term ‘Tikkun Olam’ in a way to make it seem like some kind of modern-day social justice program. In fact, ‘Tikkun Olam’ is a Kabbalist term that made its way into Judaism by way of the Aleinu prayer that is specific to Rosh Hashanah. ‘Tikkun Olam’ is not from the Torah (md’oraita) in origin at all – and therefore not one of the 613 obligatory commandments (mitzvot) nor anywhere to be found in the normative rabbinical literature concerning the praxises of Jewish Law (Halacha). Rather, as a kind of companion bit of moral guidance, ‘Tikkun Olam’ urges Jews to repair one’s individual relationship to the Almighty by way of observance of the actual ‘mitzvot’, or obligatory commandments that lead to perfecting personal behavior.

Now, just as ‘perfecting of one’s personal behavior before the Almighty’ has nothing to do with the social justice narrative per se, neither does it have anything to do with supporting a communist/Marxist, pro-Maoist organization, one of whose BLM co-founders’ declaration of the group’s Marxist ideology was featured on Twitter just days ago. Yes, the BLM movement was founded by three African-American women with longtime Marxist backgrounds: Alicia Garza, Opal I. Tometi, and Patrisse M. Cullors. Its original Platform (issued in August 2016, but scrubbed up a bit in its more recent iteration) called for collective ownership of all resources, the breaking up of banks, redistribution of wealth by way of confiscatory taxes on ‘high earners,’ free health care, and free education. Truly, Karl Marx would have blushed.

But back to the question of how BLM rioters came to be rampaging through Jewish neighborhoods of Los Angeles, CA, reportedly shouting “F___Jews”, and spray painting “F___Israel” and “Free Palestine” on the walls of the Congregation Beth Israel and at least four other synagogues. How did Jews come to be collectivized into the enemy “white privilege proletariat” class by these BLM Marxists?

That original BLM Platform also explicitly supports the BDS (Boycott, Divest, and Sanction) movement. Another indicator comes from Cullors (who organized the 30 May pogrom in LA): she reportedly told a New York Times reporter, “Let’s go into the heart of what is symbolically white in Los Angeles, which is Beverly Hills…These people need to hear our pain and our grief. We wanted to bring this to communities who often aren’t dealing with police violence.” No matter the color of their skin, therefore, Jews are going to be labeled “white”—as a pejorative from which it is always going to be impossible to escape. It goes back farther than that, however. By 2015, BLM representatives traveled to the Middle East to make common cause with Palestinians in Gaza, Judea and Samaria. Fast forward to late May 2020, shortly after the death of George Floyd, and the Democratic Socialists of America’s BDS national working group blatantly tried to link that killing to Israel, by claiming that U.S. police forces learned riot control techniques from Israeli police. Then, on June 1, Al-Awda, the Palestinian Right of Return Coalition, published a hideous cartoon at its website showing an Israeli soldier with his knee on the neck of a keffiyeh’ed Palestinian, arm-in-arm with an American police officer with his knee on the neck of a black man. The article it accompanied was entitled “Al-Awda PRRC statement of solidarity for Black lives and Black struggle.”

The BLM’s Marxist agenda is on full display across America today. Exploitation of the insurrectionist riots in which it plays a leading role to demonize Jews and Israel is, too.

The patriots delved into issues surrounding social media censorship and the rise of Parler, a micro-blogging platform where non-socialists are finding refuge. Amy Mek discussed her personal experience being suspended on Twitter. Mek also explained President Donald Trump’s Executive Order on Social Media censorship, which has been discussed in detail at RAIR.

One overarching theme of the discussion is how conservatives need to come together to support one another in this time of rampant social media tyranny, which is spilling over into life in general for anyone who does not support the Marxist rage mob sweeping the planet.

I received the following important response to the article “Churches Must Address Fundamentals, Not Symptoms,” June 15, 2020:Thank you for sending this. One thing that I am struggling with is what is my responsibility as an American Christian in all of this? Are we to sit idly by and watch our country fall to this communist backed chaos? ----- from where I live a small town was invaded by BLM & Antifa protesters on Friday night. They were threatening a local business owner who was also on the school board. He refused to bow to their social justice demands by apologizing for statements that he made against them. Heavily armed militia groups surrounded his place of business. The BLM protesters issued threats of intimidation on social media and said they were coming to town armed. In the middle was ------ who was on the police swat team. In the past month he has been to two riots and seen one of his fellow police officers brutally gunned down by two black thugs who car jacked an innocent woman [see website report]. None of this of course made the national news.

The weekend prior to this in a small town close to where I live nearly a thousand protesters from Detroit were bused in by Antifa and BLM. ----- who is a firefighter and EMS medic was on standby for trouble all weekend. He trains with the county SWAT team as a medic. In both of these cases we prayed much for peaceful resolutions. So far, that has been the outcome, however my patience with doing nothing is wearing very thin. These groups are openly using intimidation tactics and receive praise for doing so.

I am an ex paratrooper and I know many Christian veterans who are struggling with watching this mess unfold and doing nothing. My first allegiance is to Christ. I am willing to do whatever His will is concerning this matter even if it means watching our country fall to communism. Unfortunately as a nation we have chosen the path that we are on and God had been no where near us for a long time.

That said, is there a responsibility as an American Christian to bear arms to defend our freedom in such a time as this? I have asked this question to many a preacher and have never received a straight answer. I am not looking for a green light to follow my flesh. What I would like is a Biblical answer in relation to the God given right to bear arms and free speech that we were granted by our founding fathers. Do we have a Christian responsibility to stand up against tyranny? Like I said my first allegiance is to Christ. I just don't want to watch my country fall to communism having not done anything to try and stop it if I should have. I hope this makes sense.

I also totally agree that prayer is the greatest weapon that we have, and that is has been the most under utilized.

Following is an edited edition of my reply to this man:

I appreciate the response. You have expressed the issue very well.

There is not one answer to your question for everyone, but Scripture gives us some clear truths that provide light in these times. Following is how I understand the practicality of the Bible’s teaching for today:

1. Americans do still have some rights to bear arms, and they should be used to defend life and property insofar as possible. Legal firearms have stopped multitudes of rapes, beatings, thefts, and murders. Legal firearms have stopped would-be mass murderers, even in church services. Many churches have appointed armed guards within the membership, and that is wise. The citizens of most nations today don’t have this liberty, and Americans should use it as long as they have it. But beyond that, what can be done with arms? Shall conservative Christian militias go to war with Antifa, BLM, et al? You know very well that it would only make matters worse and it would be very short-lived. The U.S. government today is much more likely to side with Antifa/BLM than any Christian militia or even someone lawfully bearing an arm in self-defense against Antifa/BLM. 2. We do have some free speech, and it is a precious, hard-won right that we should use. I would love to see more pastors and Christians speak out publicly to give a biblical perspective on prevailing issues. In my experience, most pastors are hiding and not even speaking out much when they are behind the pulpit itself. They are truly the silent majority. Some write to me and say, “I support what you are saying, but please don’t use my name.” Cowards! I thank the Lord for men who are outspoken, but they are certainly in the extreme minority. Speak out for truth and righteousness, brethren! We would hasten to say that one must be very careful about he uses his time. Speaking out against the problems that blight our nation can easily become a full-time job and can entice you into the addicting and unwholesome world of “conservativism.”

3. We have the responsibility to obey God when man’s laws contradict God’s. “Then Peter and the other apostles answered and said, We ought to obey God rather than men” (Ac. 5:29). Many churches exercised that responsibility during the coronavirus lockdowns when some state governments put Walmart before churches and tried to force unreasonable conditions on the assemblies. When the government impudently exalts itself over God’s laws, such as in the matter of marriage, we must obey the higher law. We have to be ready to pay the price, of course, but this is legitimate Christian duty.

4. Personally, I’m not going to spend any time with demonstrations and sign waving and politicking, and very little time even speaking out on such matters, because God has given me more important things to do, as I have described in the report “Churches Must Address Fundamentals, Not Symptoms.” I’m going to spend my fleeting time in prayer, lots of prayer, serious Bible reading/study/meditation, preaching/teaching God’s Word, building New Testament churches, building up godly homes, discipling youth, training preachers, preaching the gospel. There is infinitely more life-changing, community-changing, nation-changing power in those things than standing on a corner holding a sign or waving the flag or going face-to-face with BLM. Others can do those things.

5. We have to understand the times. “And of the children of Issachar, which were men that had understanding of the times, to know what Israel ought to do” (1 Chronicles 12:32). The 21st century is not the 18th. Taking up arms as a patriot in the 1770s was an entirely different thing than taking up arms today. I am convinced that it is God who is judging America, and I have no intention of fighting against God. We could wish that America could be split into two parts, one that holds to its founding principles and the other a leftist state, but it’s nothing going to happen. It’s not time to build nations; it’s time to build churches. It’s time to focus like a laser on the imminent return of Christ and let loose of this old world and be ready to go, to make sure we are not like Lot’s wife, whose heart was so attached to Sodom that she could not bear to leave it. “And that, knowing the time, that now it is high time to awake out of sleep: for now is our salvation nearer than when we believed. The night is far spent, the day is at hand: let us therefore cast off the works of darkness, and let us put on the armour of light. Let us walk honestly, as in the day; not in rioting and drunkenness, not in chambering and wantonness, not in strife and envying. But put ye on the Lord Jesus Christ, and make not provision for the flesh, to fulfil the lusts thereof” (Romans 13:1-14).

6. The America of today, and the American government of today, is not that of the Founding Fathers; it is not that into which I was born in 1949; it is not even that which I served in the U.S. Army in the late 1960s and early 1970s, including a tour in Vietnam. I love America and thank the Lord for what it has stood for and for the blessings and liberties I have enjoyed as an American citizen. The flag still thrills me, but I can’t wave it very passionately today. It stands for too many things that are evil and wrong-headed: abortion on demand, moral license, homosexual rights (the Supreme Court strengthened those rights just recently), socialism (even the Republicans are redistribution-of-wealth socialists, as far as I’m concerned), the welfare state, vast corruption and insane waste, unsustainable debt, speech control (is there freedom of speech in the public schools, law enforcement, the military?), among others. America’s real problem is not systemic racism, it is systemic wickedness.

7. As for law enforcement, it is essential, of course. It is of God (Romans 13). The city, county, state, and federal police forces are absolutely necessary, and more than ever when the spirit of anarchy has spread so widely. It is time for every law-abiding citizen to show support for and to encourage the men and women who stand between us and anarchy. The two black women in Nashville did the right thing in paying for a deputy sheriff’s meal at a Cracker Barrel, leaving him a note saying, “BLM but so does yours! Thank you for your service. Breakfast paid.”

The “defund the police” movement is tyranny on the part of the movers and shakers, and it is utopian nonsense on the part of their gullible pawns. Ultimately it will fail, but many lives will be destroyed and America will be weakened, which is the fundamental objective, of course.

At the same time, we aren’t going to wave a “blue flag.” We know that law enforcement personnel are just people. We don’t idealize them. The Bible tells us that law enforcers, like all other men, are sinners (Romans 3:23). They come in all varieties. Some serve God and man; others serve only themselves. Some are diligent; some lazy. Some are honest; some corrupt. Some are kind; some aren’t. We have lived about half of our 70 years overseas, and in our experience American law enforcers are far better than those in most countries; there is more professionalism, more true justice in America. But there is no semblance of perfection anywhere.

There has been a deep corruption of the American justice system by the application of humanistic thinking and the brash rejection of biblical truth. There is a coddling of the wicked, who are treated with more respect and compassion than their victims. There is a revolving door that releases violent criminals back into society to wreak more havoc. There are endless appeals that delay justice beyond reason. Procedure is often more important than justice. There is the acceptance of psychological mumbo-jumbo. Lawyers are too often allowed to manipulate the system to thwart justice. The U.S. justice system has become more about money than justice. It’s big business. Politics plays a major role at every level.

There has been a militarization of the city, county, state, and federal police forces in the last few decades that is disturbing. We realize that the drug phenomena and the increased violence of American society has required corresponding changes in law enforcement, but when you see hyper-armed, militarized agents make heavy-handed arrests of non-violent people (such as for possession and distribution of some supplement or for simple possession of an illegal firearm or for disobeying a medical lockdown order or for homeschooling or for trumped up charges of child abuse or for assisting a mother who fled the country to protect her daughter from being forced to live with a lesbian--the Lisa/Isabella Miller Case--and other things). Why dress like and act like SS troopers in such cases? Consider the intimidating SWAT personnel who lined up against a peaceful “reopen California” demonstration in May that was composed of families in Sacramento, California; the SWATers were rightly rebuked by a former Marine.

Even the FBI has been corrupted at a high level in recent years. Some have broken laws and probably committed treason, but there have been no real consequences from the justice department.

There has been increase in unlawful harassment of street preachers and churches by law enforcement in many parts of the country. Many cases occurred during the coronavirus lockdown. A recent example occurred at a Black Lives Matter protest in Clovis, New Mexico, where police threatened to arrest preachers for “inciting a riot” when all they were doing was preaching that Jesus Christ desires to save all men of all colors. The inciters are the BLM crowd, not preachers of the gospel! We have reported many cases like this over the years, including actual arrests of law-abiding street preachers. Law enforcers should know that their best friends are Bible-believing Christians, and they would be wise to defend their friends’ Constitutional rights.

8. I hope you will treat the report “Churches Must Address Fundamentals, Not Symptoms” seriously and not just skim it. We must address the fundamentals, and God has given us the resources to do so: the frightful condition of the churches, the spiritually weak condition of the families, the issue of a regenerate church membership, the issue of the weak biblical character of the churches, the general lack of skill in handling God’s Word, the prevailing worldliness in homes and churches, the lack of vision and real passion for evangelism in most churches. You mentioned prayer and said it is our greatest weapon and it has been under utilized. But this needs to be emphasized and corrected. Until our individual believers, our homes, and our churches are the prayer warriors they need to be, we shouldn’t be thinking about anything else. I doubt that there are 50 truly praying churches in America. (A true praying church must not only be engaged in a lot of prayer, but it must be on “praying ground,” which requires a holy, pilgrim, separated lifestyle.)

I am trying to say that these are the things that most of God’s people are not doing very well, yet these are the very things God has told us to do. Any fleshly person can sit around and grumble about Antifa and BLM and socialism and coronavirus, etc., but only spiritual people can do the things God has told us to do that would make a real difference. You mentioned soldiers, firefighters, medics, and police. They usually take their jobs very seriously and do their very best, train hard, seek to improve. We need that type of energy focused on spiritual things, but very few members of fundamental Baptist churches are doing this. For the most part, they love sports and fishing and hunting and guns and barbecue and video games and politics and their jobs and Rush Limbaugh and Fox News and Breitbart, but they don’t have that passion for the Bible and prayer and holiness and ministry. A few do. But a few real disciples in the midst of a bunch of half-hearted and lukewarm is not a New Testament church. It is a mixed multitude of little power.

Unless you are a very, very unusual Christian today, you would do well to follow the counsel in the recent article “For Those Frustrated by Coronavirus and Rioting.” (1) Take a fast or near fast from secular news and political commentary. (2) Cut your social media time way, way down, if not cut it off entirely, and cut your entertainment time way, way down. (3) Take all of those precious hours that you gain from cutting way down on political news and social media and playing and spend them immersing yourself in the Word of God and prayer. Following are some suggestions for this: Go through the course Understanding the Bible for Yourself. Make your own timeline of Bible history. After that, read the entire Bible twice in six months, which requires about 14 chapters a day. Engage in memorizing and meditating on Bible verses. Increase the time you spend in intercessory prayer and in seeking wisdom from God. Make sure you are having daily family prayer. Get a prayer partner and meet daily for prayer, or as regularly as possible. Spend more time in congregational prayer. These kind of things bring real change, to individuals, to homes, to churches, to nations. Let’s stop fighting spiritual battles with weapons of the flesh.

How is your prayer life? How is your home? How are your children doing? How is your church doing? How many are hearing the gospel by your efforts? I would urge you to focus on these things like a laser and up your game in these matters no matter where you might currently be.

More than paratroopers and SWAT, America needs real Christian soldiers. Paul was a special forces spiritual soldier, and he said, “Brethren, be followers together of me, and mark them which walk so as ye have us for an ensample” (Philippians 3:17).

 

JUDGE RULES NEW YORK GAVE “PREFERENTIAL TREATMENT” TO MASS PROTESTS WHILE “DISCOURAGING” RELIGIOUS GATHERINGS

ALBANY, N.Y. — A federal judge has ruled that the State of New York, while having a valid interest in slowing the spread of COVID-19, must give religious gatherings the same rights as secular industries in its reopening plan. He also opined that Gov. Andrew Cuomo and New York City Mayor Bill de Blasio gave “preferential treatment” to mass protests over the death of George Floyd by supporting the crowds while maintaining restrictions on the size of religious gatherings.

“Governor Cuomo and Mayor de Blasio could have just as easily discouraged protests, short of condemning their message, in the name of public health and exercised discretion to suspend enforcement for public safety reasons instead of encouraging what they knew was a flagrant disregard of the outdoor limits and social distancing rules,” wrote Judge Gary Sharpe, nominated to the bench by then-President George W. Bush, on Friday.

“They could have also been silent. But by acting as they did, Governor Cuomo and Mayor de Blasio sent a clear message that mass protests are deserving of preferential treatment,” he said.

Two Roman Catholic priests and three members of an Orthodox Jewish synagogue had sued Cuomo and De Blasio, as well as Attorney General Letitia James, for restrictions on religious gatherings that they said burdened their free exercise of religion.

“On one occasion, the congregation was holding a prayer service outside [in March] when a police officer arrived and informed them that they were conducting an ‘illegal gathering,’ despite the fact that only eight congregants were present, and they ‘were at least 20 feet apart from each other,'” Sharpe explained regarding the grievance of one attendee of Chabad of Marine Park.

“When the congregants refused to disperse, the police officer threatened them with fines and arrest.”

“Perr and his fellow congregants were subject to ‘constant police presence and interference,’ which caused them to live in fear and took from them the ‘tranquility of worship,'” Sharpe said of another complainant.

One man attempted to hold services in his back yard, but “he was subjected to harassment and ‘bullying’ from his neighbors,” Sharpe said, “which he alleges was ‘incited by . . . [Mayor] de Blasio, who vowed to crack down on the Jewish community for failing to observe [Governor] Cuomo’s ban on religious gatherings.'”

As previously reported, in March, Cuomo issued Executive Order 202.10, which states that “[n]on-essential gatherings of individuals of any size for any reason (e.g. parties, celebrations or other social events) are canceled or postponed at this time.”

A guidance webpage from Empire State Development outlined that, in relation to religious gatherings, in-person church gatherings “of any size,” including house church meetings, were “canceled or postponed.”

“Pursuant to Executive Order 202.10, all non-essential gatherings of individuals of any size for any reasons (e.g. worship services, parties, celebrations, or other social events) are canceled or postponed,” the page read. “Congregate services within houses of worship are prohibited.”

“Further, individuals should not gather in houses of worship, homes, or other locations for religious services until the end of this public health emergency,” it stated.

Likewise, de Blasio warned faith leaders that same month not to open their doors or the New York Police Department (NYPD) and/or other entities would shut the building down — and if there were repeated and willful violations, the facility could be shut down permanently.

“So, I want to say to all those who are preparing the potential of religious services this weekend, if you go to your synagogue, if you go to your church and attempt to hold services after having been told so often not to, our enforcement agents will have no choice but to shut down those services,” he said, adding that it is the “last thing he would like to do” because he understands the importance of faith.

“So, the NYPD, Fire Department, Buildings Department, everyone has been instructed that if they see worship services going on, they will go to the officials of that congregation, they’ll inform them they need to stop the services and disperse. If that does not happen, they will take additional action up to the point of fines and potentially closing the building permanently.”

For areas that were approved for Phase 2 of the reopening plan, the State recently allowed up to 10 people to gather for religious meetings, and soon “relaxed” the restriction to 25 percent capacity. In New York City, however, the 10-person limit remains in effect for both indoor and outdoor services.

On June 10, the two Catholic priests and three Jewish synagogue members sued Cuomo and de Blasio, asserting that the restrictions are “arbitrary” and “pseudo-scientific.”

“[W]hile defendants jointly impose this arbitrary, pseudo-scientific regime of strict gathering limits for some groups and activities but not others, they are permitting closely packed gatherings of thousands to protest the wrongful death of George Floyd at the hands of a police officer, which have been taking place in New York City and every other major city in New York State day-after-day since Floyd’s death on May 25,” the complaint stated.

“Favored businesses, entities and activities, as well as favored mass demonstrations such as those over the death of George Floyd, are totally exempt from the challenged gathering limits, while defendants irrationally and capriciously continue to forbid religious ceremonies, high-school graduations, children playing in the park, and other comparatively tiny gatherings on the now patently specious grounds that they will cause death if allowed to occur,” it said.

On Friday, Judge Sharpe agreed. He pointed argument submitted by the State and City of New York, which he did not find persuasive. Sharpe said that Cuomo and de Blasio had the power to regulate the protests, but both their words and actions served as a statement that they were giving the masses in the streets a pass.

He quoted from both Cuomo and de Blasio, the latter of whom stated that the national outrage over Floyd’s death “is not the same question as the understandably aggrieved store owner, or the devout religious person who wants to go back to services.”

“Despite the State’s claim that enforcement power rests with local authorities in an effort to show that selective enforcement against mass race protesters is not a de facto exemption imposed by Governor Cuomo or Attorney General James, Governor Cuomo clearly has authority over the New York State Police and broad powers of enforcement,” Sharpe wrote.

“And, in any case, Governor Cuomo’s comments, which applauded and encouraged protesting and discouraged others from violating the outdoor limitations, likely demonstrate the creation of a de facto exemption.”

“Mayor de Blasio is a ‘local authority’ with clear enforcement power and has at his disposal one of the largest municipal police departments in the world, and has also actively encouraged participation in protests and openly discouraged religious gatherings and threatened religious worshipers,” Sharpe stated.

He further noted that retail stores and restaurants are allowed to operate at 50% capacity during Phase 2, but “the 25% indoor capacity limitation applies only to houses of worship.”

“Indeed, that limitation is the only one of its kind in the tangle of executive orders and the guidance document that have been issued in response to the pandemic; in other words, no other secular entity, save for those that remain closed in their entirety until Phase 4 or beyond, are limited to only 25% capacity.”

Sharpe also pointed out that, starting today, outdoor and indoor graduations may accommodate up to 150 people, and so, “the State must extend a similar exemption to plaintiffs absent a compelling reason to the contrary.”

“[T]here is nothing materially different about a graduation ceremony and a religious gathering such that defendants’ justifications for a difference in treatment can be found compelling,” he said.

Sharpe consequently placed an injunction on the State and City from placing a burden on religious gatherings that is unequal to those industries in Phase 2 and prohibited the government from “enforcing any limitation for outdoor gatherings provided that
participants in such gatherings follow social distancing requirements.”

“We are pleased that Judge Sharpe was able to see through the sham of Governor Cuomo’s ‘Social Distancing Protocol’ which went right out the window as soon as he and Mayor de Blasio saw a mass protest movement they favored taking to the streets by the thousands,” remarked Special Counsel Christopher Ferrara. “Suddenly, the limit on ‘mass gatherings’ was no longer necessary to ‘save lives.’ Yet they were continuing to ban high school graduations and other outdoor gatherings exceeding a mere 25 people.”
